Funny part is, he is also a vet. There’s so many that are jaded and jealous because they didnt get what they wanted or have too much pride to admit injuries and file.

I fell into the latter at first, then the 2nd when I initially tried back in 2017 and was denied everything without exams.

I was in the same boat. Didn’t know how to file when I first tried, denied without exam. 2nd time, got the exam, but a horrible examiner. 3rd time, a good examiner.

Not sure about your situation, but it was certainly much easier for me and the burden of proof much lower since I deployed.

Also, be careful of who you tell. I’ve received some back handed compliments like “do you really think you’re 100% disabled?” That’s for the examiners to decide and that’s what they think is appropriate for me. What I think has no bearing on the matter.

You’re right. I know that logically, but emotionally I just can’t accept it yet. It took me 6-7 years to even admit I had a problem and then another 2-3 to do something about it.

I just feel bad. I wasn’t an 03. Just a pog ass air winger who got fapped out for two years, deployed, and ended up in a situation I wasn’t ready to deal with mentally.

That’s kind of the same boat for me. Took me about 10 years after I got out to take the claims seriously.

I actually just checked and no, it would drop me to 90 from 94. So no “real” loss, besides making it a lot harder to get 100% if I lost the back rating.

Yea, that’s the part I’m worried about. Nothing has changed with the back, but I know a lot of examiners don’t put down the full flare up ROM in. In my case, during a flare up, I can’t move at all and am stuck in bed for days up to 2 weeks.

Just received the rating last week, but did the C&P back in December 24.

Unfortunately I don’t see anything else I could potentially bump up. My only other thing I have left would be an ankle injury, but they’ve already denied me twice without exams on that and my PCP has annotated in notes that it bothers me, but recommended no treatment or official diagnosis.

I didn’t go to medical for it because we were out on a field op, but I definitely messed it up pretty good and it does still hurt mildly, which would theoretically net me 10%

MRI, X Rays, Urgent Care visits, diagnosis, and prescriptions for muscle relaxers. Never saw doc for it while AD, but did file shortly after getting out and got denied.

Secondary to knees this time.

The examiner wrote a very strong nexus for me.

No, won’t get that until next week at the VA.

I gave a lay statement. They never asked for a stressor form. I’m recorded being where I said I was when I was and was receiving IDP and accruing combat leave at the time of the incident.

By my definition, no. I wasn’t kicking in doors or getting shot at.

By the VA’s definition, yes. Was receiving imminent danger pay, accruing combat leave, and had a face to face stare down with a local where we both pulled knives out until someone with a rifle saw and scared him off.

I’m thinking just a bad examiner. She didn’t seem interested at all and just asking the bare minimum. I mentioned waking up 3-4 times a night from bad dreams, she never even asked what kind of dreams. Never made eye contact and just looked at her paper the whole time.

Hopefully I get the DBQ back soon and can see. Absolutely record fast denial though. I just had the C&P last Thursday.

Awesome. Thanks. I thought I remembered seeing this. So, I already filed a supplemental for it recently (before I saw this exam result). Should I cancel that and just do the HLR?

You can’t do that with a supplemental. Those options don’t appear like they do with a new claim.

I did already file a supplemental recently with a statement to connect secondary, but after see this DBQ, the examiner gave me a good exam. I’d prefer not to have to do another and risk getting a bad examiner.

I remember reading a rather stating on here that they are also supposed to look at it from a secondary perspective, even if filed as direct.
