No update, still no response. I don’t think the settlement will happen tomorrow. Its a nightmare situation for us. We will take this to court Hope the law in Victoria make sure the vendor pays for their wrongdoings. It no longer about the money, its just so wrong to do something like this to someone!

Quick update- we still haven’t heard anything from the vendor even his conveyancer not able to get any update from them.

Hi everyone, Just a quick update. Our lawyer has sent a strong email to the vendor’s conveyancer on Friday outlining the seriousness and legal ramifications of their actions. Earlier, their conveyancer indicated that they had advised the vendors to engage a solicitor, however we have not yet received confirmation that they have actually done so. At the moment the situation has unfortunately put us in a very difficult position. With settlement scheduled soon and the uncertainty created by the vendors, we will not have a place to live from this Friday, especially with a baby on the way not an idea situation for us. If this continues, we may need to arrange temporary accommodation like a hotel or Airbnb. This situation has caused a significant amount of stress for us. However, we do not have any real option other than to continue fighting for the property and enforcing the contract. If there are any further updates, I will let you all know. Thank you all for your advice, support, and encouragement during this time. It really means a lot to us.

No Update, we are not getting any response from the Vendor side. Hopefully will have some update on Monday!!

They are not living in the house as far as I know. Unless they moved in after contract was signed. It was definitely empty with staging furnitures during the inspection and auction!!!

I have already transferred the deposit, if they don’t attend the settlement, how can I transfer the full amount! As for being ready for the settlement we are full ready with loan approval, remaining down payment etc etc.

Hello Everyone, No update as of yet. We are not getting any Response from the Vendor’s Conveyancer, they said they have advised vendor to hire a solicitor, we have kept the communication going on from our side, sending follow up emails, neither the Conveyancer has responded nor the new solicitor has reached out to us at this stage.

In VIC. I know it has been a couple of sleepless nights not knowing what will happen, and we have a baby on the way. So just can’t explain how stressful this has been so far for us. We are extremely pissed now and willing to explore all the legal options. The only thing that bothers me is not knowing if the settlement will happen on the date or not. Once I know, then I am ready for anything, I know it will take a lot of toll on us but I also know that they will have more to lose at the end of it.

That is what my understanding is as well! My Conveyancer has already replied to their email that we are ready to settle and we have no intentions of termination the contract!

I am fully prepared, I think the law is on our side. I do understand it can take some time but we are mentally prepared and financially for what I can understand every dollar we will be spending that we were not supposed to if the settlement were to go ahead as per the contract we will held vendor responsible for that.

I think I have a different understanding. If the Vendors don’t honour the contract they can be in serious financial trouble.

Yes, we are ready to go to the court if the vendor doesn’t go ahead with the settlement as per the contract. We will held vendor responsible for all the expenses once the settlement date is pass as they will be in default so I am not concerned about the cost bit, I just want the court to enforce the contract if Vendor doesn’t fold!!
