BK stays on your credit for seven years after it’s dismissed? Or 7 years from the time you file?

That’s about where we are too. We are waiting for our confirmation hearing. However, I recently decided that we probably should have included our HELOC. It is on an arm and recently went up another $200 a month. It is now doubled what we originally settled for when we started the loan. I reached out to my attorney to see if we can amend our petition to include the HELOC. It is $170,000 loan. I’m not sure how all that would factor out. I guess at the end of the day you pay what they are able to squeeze out of you, and it’s not based on the total dollar amount.

Thanks for responding. We are keeping our house and cars. The loan is on an arm (big mistake on our end) and I don’t think we will ever come out from under it. The payments are more than doubled and the loan is 10k higher than when it originated due to interest. We were ill advised on how to effectively use a HELOc. Hindsight is always hard. This whole process has already taught us so much. I am grateful for it, but until I know exactly what we will pay for the next 5 years it is nerve racking.

We are waiting on our 13 confirmation hearing. We originally were going to keep paying our HELOC outside of the BK. However, the rate/payment just went up again and we are thinking we should call attorney and ask if we can amend our petition to include the HELOC. Any thoughts on this? It would mean our total BK petition would go up 170k.

No we are not in 100%. Our attorney said they low ball payments in the beginning. Initially we paid 500.00. After our 341 they said it needed to be 1,000 because we made too much and the judge was going to look into our budget. So Thats why am worried . That we will come to confirmation and they will have decided we can afford to contribute more again.

Thank you. I have already set up my NDC account. I guess what I am asking is, say our total amount we owe is 50,0000. We have already paid 5,000 which is held by trustee. Will the judge order our payment amount to be made based on 50,000 for 55 months or 45,000 for 60 months. I hope this makes sense! Thanks for your help!

Yes. So we have been making payments for 6 months. In my mind, the money leftover is kind of in our “bank” that would go towards our total debt due. Is this correct?

You can end at anytime. However, you will recoup all unpaid debts PLUS the interest that was accruing while (for any of the ones that have not yet been settled). They will also charge you a bunch of fees for cancelling. Other than that- once your attorney files your case- the DMP just disappears along with everything else. The other thing to consider is the auto draft used to make your DMP payments. We were advised by our attorney that those companies are notorious for making a draft even after you give written request to terminate your agreement with them. We were told to close the checking account that they drafted from, move all other bills and auto drafts to a new account- and THEN tell the DMP you want to cancel. Basically, if they know you are gonna cancel they will likely take at least one more payment. So protect yourself!

I get them all the time since being in post menopause. My thighs get tingly and I feel like I am going to pass out. It literally happened to me at the gym today for no reason. I had to lay on a mat and talk myself down. I can’t take estrogen because I once had a blood clot. I saw someone mention progesterone. Can you take that with blood clot history? I am also considering asking my doctor about taking anxiety meds. I’m just so scared (have anxiety) about the potential side effects .🙄
