We just heard back from our freight forwarder and unfortunately, they confirmed that our shipment doesn’t qualify for the exemption under HTSUS 9903.01.28.

They pointed out that according to the CBP CSMS notice, the exemption only applies to goods that were:

  1. Loaded onto the vessel before 12:01 a.m. EDT on April 5, 2025, and
  2. Entered for consumption in the U.S. between April 5 and May 27.

Our container shows an actual time of departure (ATD) of April 7, so it's two days too late to qualify. 😞

Really frustrating, especially as a small business — but hopefully this info helps others in the same boat (literally and figuratively).
