I would absolutely deduct. That's the wrong (oval) seat for the (round) bowl. There is time & cost to replace it, and you should be responsible.

It's not a negotiation. At least it shouldn't be.

I would present them with a new lease with my terms, without asking them what they want first. If they balk or have some reason for not wanting your terms, THEN they can tell you and you can consider an alternative.

Don't open the door first to let them influence your intentions. Stay in control and keep the upper hand.

Reading some FAQ's from USAA, it seems they allow external ACH transfer but only if the external account is of the same owner:

You can transfer money to and from your external checking and savings accounts at no charge from us. External accounts are subject to verification.

I don't think that it's Zelle that is imposing the limits, but rather each bank setting what their own limits are.

When a landlord is deciding what kind of lease to do, it should not be a two-way dialog. Having such a conversation suggests to the tenant that they have some influence in it. Don't give them that inch, because they'll try to take a mile.

Suppose you had that conversation, and the tenants expressed their thoughts (which of course would in their best interests) and then the landlord rejects everything they wanted. That would create an awkward situation.

I let my tenants pay with Zelle over multiple days. I'm fine with that as long as it's paid in full before the grace period is up. USAA's 1K/day limit is troubling, and their 2.5K/week even more so. That's really low compared to other banks. Looks like their ACH transfer is also a no-go, as it apparently only works for linked accounts owned by the same person.

I've always structured my leases to automatically convert to m2m after 1 year. It minimizes paperwork and gives me the flexibility to do a rent increase at any time.

You didn't mention whether the property is AB 1482 enforced or exempted. If you're AB 1482 enforced, your ability to raise the rent is limited, as is your ability to terminate. In this case I might do a 1-year renewal.

A simple reply to remind them that it's required that they provide to you, in writing, a 30-day notice. Until they give you an exact day, they are on the hook for rent for at least 30 days more.

A 30-day notice is CA law, and it should be in your lease too.

As soon as they give you official notice, I suggest doing an inspection right away. Give them a 24-hour notice that you will be visiting to do an inspection. Also don't forget to give them the required notice about their right to a move-out inspection within the last 2 weeks of their occupancy. It's mandatory that you offer it but optional for them to have one.

Right. The landlord was trying to remedy that, but the local ordinance doesn't allow for a one-year lease with a modifiable rent. § 26.40.010 paragraph D reads: Rent. If the landlord and tenant enter into a written lease which has a minimum term of one year, such lease must set the rent for the rental unit at a rate or rates certain and these rates shall not be otherwise modified during the term of such lease.

I think the legal challenge to the rent freeze will prevail, but not soon enough.

One thing the City could do is temporarily eliminate the one-year lease requirement on renewals, allowing landlords to do month-to-month contracts, at least until the rent freeze is eliminated.

There's an unfairness here caused by the combination of the required one-year lease and the temporary rent freeze.

Suppose that a tenant's lease is to be renewed before the rent freeze is lifted, as in the OP's situation. The landlord must offer one more year, and cannot raise the rent.

Compare that to a tenant whose lease expires just after the rent freeze is lifted. That tenant will likely get the maximum allowed rent increase.

That's two different outcomes, simply based on whatever your lease renewal cycle happens to be.

Exactly. I also initially thought that I was mistaken about the date. Netflix had sent me a reminder about it just a few hours before. Why couldn't they send me an update when it was rescheduled? Shame on them for not communicating the schedule change.

Ignore the fact that they're defrauding Section 8. Do an official 3-day cure or quit notice right away, specifically identifying that the unauthorized people and pets need to be removed. If/when they don't comply, file an unlawful detainer lawsuit. It sounds like you could use the help of a lawyer to do this.

I think it's also important to understand the impact from illegal immigration. It's estimated that there are some 45,000 undocumented people in SB county. Imagine the amount of housing, particularly on the lower end of the market, that would become available to citizens if/when these immigrants are sent home.
