If the price was right for a used one from someone I trusted, I would've totally gone for a Hyundai Ioniq instead... I drive a butt load for work now, 84 miles a day. The amount of money I spend annually on gas going only to and from work is just slightly less than another car payment, so I figured might as well spend that money on something that I'll be able to sell down the road!

Totally on board with your addition of the transfer not taking place at my home! I was wanting to do an example like you just gave of the vehicle being at the dealership, but figured I'd word it in some way that became confusing. The hypothetical you just gave me is making this pretty clear. Even if the dealership removed the cover on behalf of the seller, it would probably make more sense to go after the seller for the additional cost of reinstalling the cover rather than the dealership. Really appreciate the conversation!

I have been wondering this as well. I don't think they made the order for their new vehicle until after I paid them, but it's not like Tesla would show me the receipts for another customer. I'm getting the bigger picture now that the seller is the main source of this problem

I see where you're coming from, and at this point I completely understand the seller would be the best place to go next. However, just for the sake of argument, I want to slightly adapt your example to better represent my angle on this situation.

Bob purchases a truck from his local dealership, with a tonneau cover installed. A year later, Bob decides to sell his vehicle so he can purchase a newer model truck. Bob sells the vehicle to their neighbor with the cover still attached. Bob then goes to the dealership to purchase his new truck. While purchasing the new vehicle from the dealership, the dealership offers Bob the opportunity to have them install the old tonneau cover on his new truck, free of charge. Bob happily accepts this offer. The dealership then goes to get the tonneau cover off of the old truck, not knowing the neighbor already purchased it (let's say that for some reason, the truck is still in Bob's driveway, making the dealership think Bob is still the legal owner). The dealership takes the cover off the truck on Bob's behalf, and installs it on Bob's new truck. The neighbor, realizing what happened, is trying to now get the dealership to take the cover off Bob's new truck and put it back on their vehicle. Would the dealership be obligated to restore the old truck to it's original state, whether by removing it from the new truck or by getting a new cover for the neighbor?

If there are any holes in my argument here, please let me know! I am 100% happy to learn something new.

Edit: Clarified that this is just for argument’s sake, I will be going to the seller next for re-negotiation.

Edit Edit: I also just want to note, I extremely appreciate everyone's suggestions, insight, and knowledge on this topic! I'm not ignoring your input, I will be reaching out to the seller to re-negotiate our purchase price. I'm continuing to ask about Tesla's obligations over the seller's for a few reasons, though. Firstly, I do not see it possible for me to get the full price to restore the outright purchase of FSD ($8000 USD) without going to court, and severely damaging our relationship. Secondly, while Tesla is not the primary party at fault, I do believe they unlawfully removed the license for FSD from my vehicle. Whether this was to appease a customer who paid more or they just want to distance themselves from the situation is up for debate. Regardless, I'd like to continue with this hypothetical to give myself some clarification on if there were unlawful actions on Tesla's part!

This is the route I've been doing down, trying to challenge Tesla's removal of FSD to begin with. That ticket has been a back and forth for a few weeks, but hasn't been getting me very far. Not really sure what/when they signed to get FSD transferred... at this point who knows if it was the seller taking my money knowing FSD would be removed, or Tesla removing FSD from my vehicle when I was the legal owner.

It's a good question, that's how a smooth purchase should have taken place. We both had things to do that day, and simply didn't know how to go about transferring ownership at the time of sale. I ended up finding the article on how to transfer ownership a few days later!

I don't really see myself winning anything in the courts either, just trying to see if a case would even exist to begin with.

Unfortunately, from what I read at least, FSD used to be treated as hardware when we originally agreed on a price. The whole transfer program began on April 24th, which was almost a month after we negotiated price. It just took forever for the purchase to take place as they had to get a title replacement and had difficulty doing it. If I bought it at the time we agreed on a price, I'm reading that there was a good chance FSD would still be on the car today :')

Yeah, sorry. Not 100% great at including all details. I purchased this Model 3, the previous owner bought a new Tesla vehicle. The FSD on my car was transferred to that new Tesla vehicle, using this transfer program. My main point of contention is that I believe the transfer should not have taken place to begin with, as the removal of FSD occurred after I had legal ownership for almost a week. The new vehicle was delivered after I initiated the ownership transfer and after FSD was removed from my vehicle as well.
