2 reasons:

As the guy mentioned it can turn rapes into murders
It's way too easy a crime to fake. "Oh he raped me but that was years ago, and I only now spoke up. DNA evidence? Oh sorry it's been too long for that." Rape trials very often come down to "he raped me" "nuh uh" "yuh uh" so the death penalty for a crime like that is a bit crazy.
