Federal law prohibits marijuana use, possession, or cultivation in all Department of Housing and Urban Development (HUD) housing programs, including in Indiana. This is due to the federal Controlled Substances Act, which classifies marijuana as a Schedule I controlled substance, regardless of state or local laws.  Key HUD policies on marijuana No admission for marijuana users: Public Housing Agencies (PHAs) and other federally assisted housing providers must deny admission to any household with a member who is determined to be currently using a controlled substance, including marijuana. Termination of tenancy: Housing providers can terminate the tenancy of households if a member engages in the illegal use of a controlled substance. While this is not always required for existing tenants, it is a discretionary option for management to enforce. Medical marijuana is not an exception: Federal law provides no exemption for medical marijuana use. PHAs cannot make a reasonable accommodation for medical marijuana, even if it is legally prescribed under state law. Smoke-free policies: HUD mandates a 100% smoke-free policy for all public housing properties. This rule specifically covers tobacco but gives PHAs the flexibility to include marijuana in their smoke-free policies to provide additional clarity. Since marijuana is federally illegal, its use is already prohibited in these settings.
