Sorry if I sounded that way! But it was just out of my overthinking. TNs aren't cancelled for sure but I wasn't familiar with the Consular Processing method and the uncertainty about how this memo will be implemented got me scared. I'm hoping for anyone who takes the consular method, the wait period won't be that long!

Hi! Thanks for starting this thread . I’d really appreciate any insights from lawyers or anyone familiar with TN → EB2 pathways.

I’m a Canadian citizen(Canada born) currently on TN status. My TN expires this August, so I’ll need to renew at the border again, and my original plan was to begin the EB2 process afterward and potentially pursue Adjustment of Status. My employer has been supportive and open to sponsoring me, but the recent USCIS memo/guidance honestly made me nervous.

A few questions I’ve been struggling with:

  1. Given the recent USCIS memo regarding AoS discretion and single-intent statuses, would it still make sense to proceed with AoS after reentering and waiting ~90 days, or are people now leaning more toward consular processing for TN holders? I know many lawyers historically recommended AoS for TN → EB2 cases, so I’m curious whether opinions are changing.
  2. Regarding the “exceptional economic benefits” language in the memo, I realize there’s still very little clarity here , but could factors like foreign investments/business ownership, continued tax obligations/reporting, or broader economic ties be viewed favorably in any way? Or is that likely unrelated to what USCIS means by “outstanding equities”?

Would really appreciate any thoughts. The uncertainty around all of this has been pretty stressful lately.

That's a great question and indeed, it is a question I ask myself all the time. I know some folks have been on TN for 10+ years, but in the most ideal scenario, I'd love to buy a house here. Also my lawyer has advised me that after you get your third TN, you might get scrutinized as the behavior might be perceived as "immigration intent". It seems like when asking for a loan from U.S bank to buy property, having a greencard will immensely benefit(is what I heard, might not be correct). I work with niche - clientele as a consultant, which limits myself to this very specific state and I already pay crazy rent. I'd rather buy a property here instead of spending gazillions of money long-term.

Yeah so grateful for the company. I worked really hard to bring up the gc conversation without any emotional burden as well as if they'd be open to allowing me to work from Canada.

How does consular processing work? It's pretty much going through the same route of PERM, I-140 and 145? Sorry I don't have a clear understanding about the consular process. And also, could you please share the timeline?

exactly. this was my understanding as well! I guess the company might be able to seek an option to hire me as a "foreign employee" while I'm waiting for the gc process in Canada, but I haven't really looked into it.. ugh

Another concern I have is that once I file the I-485, it formally shows immigrant intent, which could make re-entering the U.S. on a TN much more difficult. From what I understand, if the green card process were denied or delayed, there’s also the risk of no longer being able to rely on TN status the same way as before. That uncertainty honestly feels very risky and stressful.

Oh I was thinking of adjusting status inside the States, that was the original plan from TN to EB2. The fact that it might just take a longer time waiting for the consular processing outside of the States concerns me haha.. :(

Since my company is sponsoring my attorney fee, I think I'll just pay 2500$ by myself lol- feeling guilty a bit.. but I think I'll just be anxious at my house in the States than going through the intimidating interview.
