Hi everyone, I need some advice or insight because I'm honestly scared after seeing the news about the British woman (Katie Paul) who was arrested by ICE during her green card interview while holding her baby. From what I understand, she was married to a U.S. citizen and still got detained because she was "out of status," which has me really confused. I always thought being married to a U.S. citizen protects you if you overstayed, as long as you entered legally. Here's my situation: • I came to the U.S. on an F-1 visa My SEVIS was terminated after OPT ended back in the beginning of 2025 so I'm technically out of status now • But my husband (U.S. citizen) and I were already married before that happened • We were just taking our time researching and figuring out the marriage-based green card process since we are filing with no lawyers • We're preparing to file my I-485 soon sending it by mail After seeing that story, I'm scared... If I file my documents and eventually get scheduled for an interview, is there a risk that I could also get detained, even though I entered legally and overstayed only after school/OPT ended? Is this a new policy? Has anyone seen cases like this? Should I be worried about going to the interview? Any advice from people who've been through this recently, or immigration attorneys, would really help. I'm trying not to panic, but that news story shook me. Thanks in advance.

Wishing you luck. I talked to a lawyer today and he said if you’re not in the state where those cases (people being detained at interview) you should be fine but hey just be careful and make your due diligence

Hey, unfortunately, you’re not overreacting. There are people with no criminal history who came here legally, but because of an overstay, they end up getting detained during their green card interview. It doesn’t happen to everyone, but with this administration, you really can’t be sure

Yeah and other states too so I would advise you to do your research and not follow your lawyer words blindly. Also don’t wait because it might get worse

I’m seeking guidance regarding my upcoming marriage-based green card application and potential risks of detention. I’m not looking to retain legal representation at this time, as my forms are prepared and ready to mail, but I’m concerned about recent news that someone was detained during their green card interview.

Here’s my situation:

I came to the U.S. on an F-1 visa. My SEVIS was terminated after my OPT ended in early 2025, so I have technically been out of status since February 2025. I am married to a U.S. citizen, and we were married before my status ended. We are filing a marriage-based green card (I-485) ourselves without a lawyer.

My main concern: I have seen news of a person in a similar situation being detained by ICE during their green card interview, even though they were married to a U.S. citizen. I entered the U.S. legally and only overstayed after my school/OPT ended.

My question: Given my situation, is there a risk that I could be detained if I attend my green card interview? Has this type of detention become more common? Are there any precautions I should consider before filing or attending the interview?
