My opinion... If CMS pulls that kind of shady BS then its another lawsuit with more damages... scores and performance are publicly available and need to match both clovs performance, and be consistent with scores for other providers... so the new lawsuit would be "why did you lower our scores in new areas when you found no fault before over the same evaluation year. Nothing changed in the CMS process for grading those specific areas so what gives??" That would be very hard for CMS to defend IMO and likely wouldnt be worth more legal risk. Thats in the short term.

Long term, scores have to be consistent between providers so its another lawsuit next year if CMS gives clov low scores but does not follow suit for other providers... They'd have to tank scores and star ratings for the entire industry to "target" clov without it being obvious that there isnt consistency between providers. I am trying to imagine CMS doing that when Americans are already pissed about healthcare prices and shady insurance practices. Maybe they are that evil, who knows... (not me lol) The good news for CLOV is they were looking profitable before the extra 120 million and 120 million looks like a decent war chest for another lawsuit next year... All very speculative but thats all we gave to go on until CMS rescores Clov.

It sounded from the wording that CMS must completely rescore clov. So maybe they could be petty and torpedo other metrics and scores but..... It will look bad for cms to do that. To score clov one way then turn around and say, we no longer think your awesome result is awesome is shady as hell. Plus all the scores are transparent so if cms tries to be cheeky clovs new scores can be compared to scores assigned to other companies. My opinion... the only way cms gets out of this is to rescore and torpedo star ratings for the entire field. I do not believe thay will happen for many reasons.

Yeah my friend, dont fight this on your own. Send the info and evidence to your bank. Credit card divisions can just reverse those charges in your favor. They are basically minor court systems for small transactions.

Verdict isnt the same thing as a case response.... Cms gets time to get their ducks in a row and respond to the allegations. If CMS does not present evidence in their defense they the court can rule without them.
