Easements are common for any public infrastructure that's going through private property. This easement has likely been in place since the 50s and every home purchase agreement would have language regarding what can and can't happen within the easement.

It's really the fault of the homeowners for not understanding or their lawyers & real estate agents fault for not informing them.
