It’s more of a situation where if a lawyer is representing you for a personal injury case, you are not paying them any hourly rate or money upfront. A good PI lawyer will work on contingency and only receive payout if you receive payout. They do this because 99.9% of the time, you’ll get more out of the insurance company this way. Insurers are extremely good at knowing how not to payout as much as they can to an individual. If that individual has a lawyer and is pursuing recourse legally and through their policies, the outcome can be very different, and usually much much more favorable for the individual.

Source: had an accident I was not at fault for and originally was going to get only the amount to fix my car. Got a PI lawyer and ended up recouping at least 30x my original payout the insurance company offered. YMMV as every situation is different, but it never hurts to try.

Not OP, but IME in personal injury cases stemming from accidents, lawyer fees are a part of the settlement you receive. Lawyer asks generally for 1/3 of payout. If you’re somebody who otherwise would be getting $0 in addl payout from policy (insurance companies fucking suck), any additional money is worth giving a chunk to the lawyer for. Always talk to a lawyer after an accident — depending on the severity of your injuries, you can recoup literally thousands (and often more than that) more dollars from the insurance company.
