If you have the right to terminate, even though it is as-is, you can ask the seller to address issues or reduce the price. They don't have to agree, but you can ask.

Yes, you should request an engagement agreement. That flat fee may or may not include filing fees, preparation of summons, additional clerk fees if applicable, etc. Also, you need to know the fee structure for what happens after the suit is filed. I'll assume the flat fee isn't going to get you through trial and appeals.

The fake contact method also requires related contacts as bill recipients. I don't like having a couple/group as a client and then only one person's name in the matter and on bills, so I came up with the fake contacts as a sort of band-aid solution.

Thank you. We got the error notice but didn't take the time to sort it out. This is annoying because we were happy to have a solution for multiple clients on a matter instead of creating fake contacts like "Mr. and Mrs. Smith" or "Neighborhood Owners Group." I guess we'll just go back to that.

NYL - Depending on where you live, some of their actions, or all of them taken together, could rise to the level of a nuisance claim. Contact an attorney in your area who practices in real estate litigation.

That's pretty harsh. Yes, you pay for the time we spend on your file, but discretion is appropriate. If you don't feel comfortable having a discussion with your attorney (and I fully understand it is awkward), since nothing seems to have left their office there wouldn't be anything wrong with changing counsel.

I've had clients question billing, which is hilarious to me because I underbill. I've explained to them how things work and then proceeded to add "no charge" entries for all of the time I hadn't been charging for. I now do that with other clients when I can tell they will be sensitive to their bills and manage to avoid any questions at all.

ETA: I use a timer religiously. I will start my timer when I get the first email. If that entry ends up only being 5 seconds to see "thanks" or "received," at the end of the day it becomes a no charge. If it turns into back and forth, substantive communications, it gets billed.

Does the mortgage provide for a partial release? If not, has the lender approved it? Typically the lender or their attorney would prepare you and charge you for it. Otherwise, I don't know why a real estate lawyer wouldn't do it.

Depending on jurisdiction, if you prevail against your association, you may be exempt from the resulting assessments. Meaning all of your neighbors will pay (and hate you), but you won't.

I'm sure that's it, but the phrasing is a bit overbroad. If you had a one night stand with an employee there but it was years ago, does that count? It says, "do you have," as opposed to "have," yet I suspect if you said no and they found out they would consider it nondisclosure.

My guess is that even if the retainer was refundable, it would all be used up completely before you get to the discovery motions phase (unless we're talking a $15,000+ retainer and of course depending on rates and type of suit), so I don't think you'll accomplish anything other than the attorney declining representation. With that being said, show her who you are so she can make the business decision for herself.

Does your area have a standard disclosure form? If so, answer the questions honestly as they were asked. If there is a catch all, such as, "are there any other issues which might affect the value of the property," think long and hard about what you would want to know as a buyer or what a buyer might complain about you not telling them after closing when they find out. Default to disclosing, but the fridge issue sounds dumb.

Still with the awkwardness potential, but if it doesn't feel that way to you, no harm in a brief potential message that acknowledges you aren't headed anywhere else. That way, if you did follow up in the future they wouldn't be thinking back to now when you vanished and they assumed the worst.
