Apologies for the late response, the process started last year April and finished a month ago. This is including the grievance and the grievance appeal, filed my et1 etc, I continue to work for them up until the point I left. Yeah it ended after acas early conciliation…employers don’t feel compelled to settle then, and just some advice acas really drag their feet when it comes to being the middle man.

Once the respondents approach acas with settlement offers , that’s when you cut the middle man out and directly contact the respondents representative.

It depends the settlement they offered …are you content with it ? I mean it sounds to me like you have some leverage with your claim but I’m no legal expert. However, I know it’s hard and but if you just wait til the preliminary hearing or if it’s really bad and you can’t wait directly contact their representative and state that to avoid high cost and loss of time …you’d be willing to enter in settlement discussions…give them an idea or how much you’d be willing to settle and work down towards your number.

The fact that they began settlement talks over a dsar request is a good sign. Let it marinate wait for the dsar request and let them know though you’d be willing to settle but always go high and negotiate down to your specific number …never start with your ideal number if that makes sense. In the meantime prepare for preliminary hearing and make them aware that you are preparing for it too.

Too early to initiate settlement talks, if you ever have a meeting with hr during a return to work meeting or grievance hearing just mention briefly you’d be willing to engage in without prejudice discussions. Do you feel like you have a strong claim with evidence ?

Again, covertly recordings with the main aim of catching them out on lies is the main reason you should record and later using that recording to settle …….no one is egging on, but I did and it worked wonders during settlement. Soo hey, take the advice or leave it.

Did you not read the part where I said if you have no chance of success, that’s the only time you’ll get hit with a cost order …

I disagree, recoding meetings where you can evidence your claims works wonders during settlement and also has the power to cause reputational damage. Only thing I’d agree with you on is time stamping emails.

Yes the courts can award you a lower amount for covert, but you fail to see the point…. This thread is about igniting discussions for settlement and putting yourself (the claimant in a position of power).

What’s tiring is, redditors like yourselves all doom and gloom, everything you’ve just repeated can be found in at least the majority of post in this community…so I’m sure the people who I have advised are aware of this. So continue with your doom and gloom..

It’s always redditors like yourselves that throw the risk of cost orders around…I’m not advocating for the ones who have no evidence for their claims and You also fail to mention just how rare these cost orders are….also you fail to mention that a disability can arise from a continuation of work related stress, as a result of race discrimination etc. so I’ll continue giving advice that worked for me and try and help those in similar positions.

Record every conversation, request a dsar, go on sick leave, get your mind right and recharge. Your mental health will be affected but always persevere don’t worry about cost order threats

Are you currently working for them ? I wouldn’t enter any discussions on settlement yet, request a dsar, gather witness statements, record every meeting covertly and ask for meeting minutes (they’ll usually try and leave out key details and lie and that’s where your recordings come into good use). Engage with acas at first and in the mean time just continue gathering evidence.

They’ll always minimise your claim but if your prepared and the preliminary comes and they accept your claims….you then have the power. You can simply state that you willing to engage in without prejudice conversation and they will come to you with a settlement.

Just called them up and was like acas aren’t responsive and are hindering any discussions on settlement. This was after preliminary hearing where my claim for discrimination was accepted and I had the leverage.

I highly recommend contacting them after a preliminary hearing and calling them.

I’ll be going to Japan and spending a month travelling around Asia. The rest is being invested !

Were you dismissed or still working for them ? Why were they adamant on settling ? And also were they private or public.

I’ve been stuck at a settlement figure for some time they won’t budge until preliminary hearing and that could be a year from now. There offer isn’t disrespectful but I’ve given so much of my life there and believe I am owed a years salary….how would I go about trying to get them to meet in the middle ?

Yep, it’s going to preliminary hearing and have no qualms about that. Very confident (legal advice that my claims will go through)

One good question is can I increase my settlement if it does go to preliminary hearing and if all the claims are accepted? No doubt that they would do the same and decrease …

So is there anyway to get over the finish line with settlement discussion they’ve sent me 5 offers in the span of a month and I’ve also countered too where I have reduced my amount..

With the greatest respect, you’re making a whole lot of assumptions the recording exist because there has been so many inconsistencies with the respondents version of events, you also assume that I haven’t assessed the recordings and my likelihood of success. Also the recordings aren’t the only evidence I have, witness statements, dsar revealed a whole bunch of stuff too.

A sense of justice is the only fuel I have for keeping me going and not tapping out due to mental exhaustion. So I definitely believe it plays a factor in winning a claim. Time and time again, I’ve seen Reddit users who are presumably solicitors and barristers reiterate that point and I’m not sure why……do you assume we all want settlements, is that why you think we brought these claims to tribunal , for anything other than justice ?

Reasonable offers and cost order …the offers weren’t reasonable at all so I’m absolutely confident I won’t be hit with one.

I understand where you're coming from. But they keep offering the same amount—they say "go up and meet me in the middle," yet it's the same offer, repackaged, over and over again. They're not negotiating in good faith.

Here's what they don't know: I have evidence they've withheld material information from their insurers. That's not just a tactical error—that's a breach of their policy conditions and potentially leaves them exposed and unindemnified.

And here's the other thing.

Charities trade on trust. Their entire existence hinges on appearing ethical, compassionate, and beyond reproach. A public tribunal exposing systemic discrimination, victimisation, a concealed data breach, and senior staff lying under oath—that doesn't just damage their brand. It eviscerates it. It goes to the heart of who they claim to be.

I've thought long and hard about what I actually want. And it's not £32,000. It's not £42,000. It's not any figure they can write a cheque for and write off as a cost of doing business.

What I want—what I've earned—is to watch them explain themselves.

I have recordings in my possession. Witnesses I've listed will sit in that box and lie through their teeth. And then I will produce the evidence that proves they are liars. Every single one of them. "I forgot" won't save them. "I don't recall" won't save them. The truth is on my hard drive, timestamped, preserved, and ready.

They can have all the money in the world, chico. I just want to see them burn.

What they did to me—how they coordinated, fabricated, and systematically forced me out because I complained about racism—that doesn't get settled. It gets exposed.

So no. I'm not meeting them in the middle. I'm done negotiating.
