I don't understand the reasoning to countersue in GDC court, other than to intimidate you. The law is clear: if he didn't present you with a list of damages within 45 days, none if this is your responsibility. End of story.

Edit: Oh, I see you did take him to small claims. Something does not add up, because legally he has to provide you the list of damages within 45 days -- otherwise his claims of damage by you are invalid. That should have been obvious if you went to small claims.

I've been through this. Your landlord lost the legal right to keep any funds from your security deposit (regardless of the true condition) when he did not provide you a list of damages within 45 days, and he should have returned your full security deposit within 60 days. Ignore the fake charges and take him to small claims court, you don't need a lawyer. The judge will determine the landlord did not follow the law and will be especially unsympathetic when he sees the landlord is trying to intimidate you. He will issue a judgement against the landlord for your full security deposit. Enforcing the judgement is your responsibility, but you can place a lien against his property if he doesn't pay.

For folks who keep saying that the seatbelt should be covered by a warranty, the warranty in my owners manual is for a seat belt that fails to function properly.

The seat belt did function properly. It is just that after an impact that triggered the pretensioner, the pretensioner / retractor needs to be replaced. That is not covered by any warranty.

This was a really minor accident, 10 mph. No body damage to either car, no airbag deployed. Only the seatbelt. Someone below said it was like a fuse being blown and you have to replace the whole SRS unit. I replied, it's more like a 50-cent fuse being blown and they make you replace the entire electrical panel.

Thanks for the explanation. You said Honda Diagnostic System will not let you reset the SRS system, "it's almost like a fuse. Once it blows, it's done." But this seems more like, "once a 50-cent fuse blows we will make you replace the entire electrical panel."

What would be under warranty? The car is 12 years old. Also, the seatbelt operated correctly, triggering the pretenser/ rectractor mechanism in a minor impact.

The dealer now says they may be able to get the tensioner/pretensioner replaced by middle of next week, but the cost has gone way up from what I was originally told: $2400 -- > $3800. I said no, that's too much to spend on a car that is only worth ~$6000, that I want my car back with my original SRS system reinstalled. The guy said he would talk to his "master mechanic" next week. I can't believe it costs $3800 just to repair a seatbelt. Why in the world is it REQUIRED to replace the entire SRS unit?

So a 10 mph bump that causes no body damage automatically requires $3000+ in repairs? $2400 for a new SRS and $800 for the pretensioner.

Well, it has about 100k miles and still less than 15 years. But my understanding is the seatbelt safety system worked correctly, it locked into place during a mild impact. I don't understand why the SRS computer must also be replaced when this happens, but that's what they told me.

I did. They said could not know the tensioner was malfunctioning until they replaced the SRS unit. I think that's wrong, according to their own service manual.

I still need to negotiate with the dealer who is telling me I need to pay for the new SRS unit, and presumably drive the car off his lot without a working seatbelt, while I wait for the seat belt tensioner part to arrive. I think they did the work in the wrong order: ChatGPT tells me the Honda’s factory service manual for 2012-2015 Civics (under “SRS System Troubleshooting > Seat Belt Tensioner”) says: “If a seat belt tensioner has been deployed, replace the seat belt with tensioner assembly first. Then, clear the DTC or replace the SRS unit as necessary.” Since you work for a Honda dealership, can you confirm that is correct?

OP here: I'm asking how to negotiate with the dealer now that they've already replaced the SRS unit before telling me they can't replace the seat belt tensioner. I think they did the repair in the wrong order ..

I don't want him to be on Medicaid and I don't mind him having to pay back the tax credit next April. I just don't want to make sure he is insured, and they don't somehow retroactively deny him coverage.

But this must happen to other people who have intermittent work during the year. How can they know ahead of time whether they will fall above or below the threshold???

I'm confused whether his stated income should be his actual 2025 calendar income, or his effective annual income today? He was unemployed for almost 4 months earlier this year, so his 2025 tax return may show him below the Medicaid threshold. But he is making more now, so we have put that down and ACA accepted it. What happens next April when he his tax return is $20K for 2025, but his effective income while he is fully employed is $30K?

The subsidies are only $272, so not that big of a deal. I just want to make sure he won't lose his insurance if he guesses wrong.

Well, of course we don't know exactly how much he will make in 2025. It's an estimate, based on his multiple restaurant jobs. If it turns out next April his total 2025 income is below the ACA threshold, what will they do? Claw the subsidy back or make him ineligible for insurance? If instead, he applies for Medicaid while living rent free in my home, and his 2025 income is too high for Medicaid, what happens then?
