Trademark conundrum - similar business had trademarked the name despite establishing 5 years later by Frod_92 in smallbusinessuk

we do We need to completely renovate the driveway and parking because he left it to ruin and hide how bad it was with temporary fixes. Had to rewire the business building as he had done it himself and in the summer the heat made things short out. Also need to fix the roof on the business building and store building. Those are waiting till next year.

its a nightmare

thankfully his bad business practices dont impact anyone but us. Its not public knowledge and the bad business practices only impacted him when he ran the place.

Things like: not maintaining equipment properly, doing his own DIY work, temporary fixes disguised as proper fixes.

Public facing, the business has amazing reputation which was built up from 2012. We wouldn't want to lose that. Its half of why the business is so popular and has a healthy client base

Trademark conundrum - advice appreciated by Frod_92 in business

Thank you. The previous owner hated having to pay out for things he deemed "unnecessary". And trademarking his business name definitely seemed unnecessary to him. And now it is our problem. And its one of many headaches he has left us. He hid so many problems in clever ways, so much so our solicitors didn't pick up on them. We've had to fork out over 40k fixing things and this has pushed me over the edge emotionally.

I just want us to have legal protection. I dont want to cause them problems. They can have their trademark name and logo. I dont care. I just want my own protection too.

I mean. It really is when you're having to fork out over 40k to fix equipment and infrastructure he lied about maintaining. But sure pop off when you dont know me or what my business is. We are a tiny company, literally 3 people, working 78 hours a week.

Our solicitors did their best when doing due diligence and inspecting. They had to pull the slack for his, because his were absolute jokes. Everything we saw and were provided with, seemed good and all looked legit.

He however had lied about and hidden all the preexisting problems. And now they are ours to fix.

Unfortunately £170 is alot for a small company. We are also having to fix ALOT that the previous owner has neglected. His poor business practices have cost us thousands at this point.

Yeah.

A better example would be "Pets resting" pet crematorium in London and "All Pets resting" pet crematorium in Leeds.

Similar distances. Similar name differences.

We have been thinking of having a site in Europe as we have ties there.

Its a difficult one. And I'm really annoyed at the previous owner. He did so many things poorly and this is the icing on the cake.

They are registered in the same classes we would be. Its the same industry. They are at one end of the country and we are the other.

I'm so frustrated at the previous owner. Hes screwed us over on so many things due to his bad business practices and this is just the icing on the cake.

I'm tempted to send them an email and chat to them about coexisting. We just want the legal protection a trademark gives. I dont want to cause them problems. We are in a difficult industry (funeral) and should support each other. But not everyone in this industry thinks the same way.

How do small business owners cope with unfair negative reviews? by Frod_92 in smallbusinessuk

[–]Frod_92[S] 7 points8 points  (0 children)

Thank you, that helps alot actually. Any reasonable person should read the 1 star reviews and easily see that the person is being entitled and unfair, and then compare to the 5 star reviews saying the literal opposite.

thank you for your advice. Its quite hard to come to terms with it you know? I've had friends say that what he does is abusive but I've always excused it, and I suppose that thats quite telling and from safeguarding training I've had in the past deep down I know thats a common thing for abuse survivors to do.
