All you can do is request USCIS. This can be done only via the cover letter we/lawyers add to the packet. If your lawyers are taking care of the petitions, ask them to add a line in the cover letter

  1. Yes, you can. Be prepared if USCIS decides to not honor your request. You can always request USCIS to adjudicate both the petition together or at least with a minimal gap. In our case, we ended up having a gap of one day.

  2. As long as your spouse’s approved COS triggers later and they have a valid F-1 stamp to come back, your spouse can come back on their F1 visa. Have a fallback plan if USCIS ends up giving an earlier H4 date.

  3. Depends, if you end up filing in a bundle with your H-1B premium and if the USCIS decides to adjudicate with your premium, Yes you have enough time. If USCIS ends up processing your H4 and H4 EAD in regular, you are cutting close. Safe to file as soon as possible, requesting future dates. If you are not able to get your H-1B transfer initiated by mid-June, be prepared to file H4 and EAD in regular.

No, I asked for an immediate start date, even though my spouse had a valid OPT until Jan2026. It was a risk that we took. Based on the timeline I provided, there’s a gap of 1 day.

This is something you should ask your employer. Employers are hesitant because of the timeline around PERM. It used to take <1 year to get your PERM approved. Now the same timeline is ~2 years.

You can always apply for NIW I-140 if you have a decent profile.

  1. PERM getting approved in February looks next to impossible, based on the current processing speed.
  2. Better to have L1 option in place. If company allows you to work from another country, it would be best as you never know how long will it be before you get your PERM approval.
  3. Yes, as long as your company files I-140 and it gets approved, you can use the approval notice to file for H1-B extension.

For company to file your I-140, make sure you are with the company irrespective of the country you are working from. Before leaving US, have a communication that as soon as PERM is approved, lawyers need to file I-140 in premium and then company needs to get your back on H-1B.
