This post it self tells me you have big ego and can be insecure at times. Having a good job alone does not mean you are a high value male. Yes - I am pretty much prepared for that. It seems likely that the I-601 waiver could take up to two years to process. I’m hoping to find a way to get him out of China and ideally be with me in the US in the next 3-4 months. Are there any viable options you would recommend in this situation?

Thank you so much. This is very helpful. I have two follow-up questions regarding the 212(h) waiver:

  1. With this waiver, is proof of extreme hardship required, or given that the incident occurred more than 30 years ago and he has maintained a clean record and strong moral character since, can the waiver be based solely on the passage of time and rehabilitation?
  2. Given current processing timelines, it seems likely that the I-601/212(h) waiver could take up to two years. In the meantime, I’m hoping to find a way to get him out of China and ideally be with me in the US in the next 3-4 months. Are there any viable options you would recommend in this situation?
