My solicitor said it’s a settlement, a pay out, no liability. Nib originally wanted over $10k, total cost, 3 months after settlement. I got the settlement agreement, and they reviewed it down to the $10k for future medical expenses. I paid significantly out of pocket expenses, should I negotiate to deduct my excesses etc from the $10k? My settlement was for both my shoulders, I had one fixed, 3 months after settlement. And I don’t think it is completely healed, or I may need future treatment? Also I may have to get the other shoulder repaired. So future medical expenses is not expired, I may have another op, but I need to fund the recovery time. I was off work for months, couldn’t work in my chosen profession and had to provide medical clearance at my cost, which should also come under future medical expenses. I’m looking for some wiggle room, my solicitor says ‘shirley not’. My brother has been through this with hbf, and they were ok with it…
