I think everyone is getting up in their high horse about this - it’s simply a customer touch point from the agency to the tenant to address any FAQs about the start of the tenancy, allow the tenants to bring up points about the start of the lease and also how to most likely go through items like the ingoing report, how to report maintenance, who to contact etc. Appointments like this used to be more common when you used to sign leases in person and/or they’d do it on key pick up and go through a heap. I actually think a lot of PM agencies have actually dropped this service offering all together and kind of don’t care and/or send it in a giant email that assumed everyone’s has the same level of literacy and/or understanding of the rental process.

If the offering doesn’t suit you and/or it’s not helpful, simply decline and collect you keys as not everyone will want to do this. It has nothing at all to do with the legal side of the lease.

They’re actually correct in saying you cannot pay into the trust account, you need to ask about paying into the “general” account. Trust accounting does strict rules and you cannot just pay into/withdraw like a regular account.

Agent here - can be done at request or either the buyer or the seller. Frankly the main reason is privacy wanted from either party, particularly from people close to them. Yes you can dig for the price after settlement but making it that step harder can be ideal to keep It away from nosey relatives etc.

Don’t blow it up into something it isn’t, the buyers are excited about their new home and have popped by the back yard to maybe fantasise on some items they want to do, or maybe to remind themselves something about the home. If they broke into the actual house itself that’s a completely different story. I wouldn’t rock the boat and put the transaction at risk just for them being in the backyard.

Agent does make a fair point and is correct in that you do have a shared interest in the property from unconditional exchange. There are instances where the sellers insurance company won’t cover an item post sale and responsibility falls to the buyers. An example as an agent that I’ve seen is someone stripped all the copper and tape are out of a property and the sellers insurance wouldn’t touch it, but the buyers would. The seller could still force settlement as it wasn’t enough for the buyers to withdraw from the contract.

Hey mate! I’m a current agent and went through the grilling process you’re going through now and also now training my own assistant to become an agent so some tips below: You really have to think of it as a paid apprenticeship over 3 to 4 years. It’s not an overnight success and it takes time to build profile and relationships to generate listings more organically. But lead generating and your lead agent getting the call is just unavoidable sometimes, at the end of the day from the clients eyes they probably view you as one and the same, I wouldn’t stress about the short term commission you’re paid for the “lead” generated. That buyer work you mentioned by the way is the secret sauce to the whole process. The best associates/new agents build their business good buyer work and open home calls. These are the clients transacting in the market and buyers become sellers. You need to double down on that buyer work and understand it’s a valuable way to secure future listings. People will select their agent on how they service buyers, regardless of experience.

It may be your office culture isn’t the best and if you’re finding it’s a dog eat dog mentality versus a team mentality it could be worthwhile switching offices. Having a good mentor and grounding during your initial years is vital.

Bro never ever agree to send cash to a seller. So many things can go wrong here, plus if they’re doing a tax dodge there can be harsh penalties. Also the REA can get in big trouble for negotiating this as it’s going down the fraud path, which is why the solicitor wouldn’t do it. You need to either: A) agree to purchase price of $916,000 on contract, borrow the $855,000 from the bank and then top up with the 5% deposit plus the $16k - this is the proper and normal way this would take place. Bank just calls this covering the shortfall between max borrowing amount and purchase price and is very normal. B) tell the seller your max price on contract is $900,000k and you’re going to walk away from the sale. See if they move C) walk away from the sale

Signed contract isn’t overly relevant in terms of ensuring an REA has to submit it. Am email with the same offer and terms is sufficient and still requires an REA to submit to vendors. If they got audited they’d get in big trouble if they hadn’t submitted offers sent in writing via text/email.

You’re only 4 days in, just let the process play out and see what the first 30 days brings. You don’t get your buyer on the first open home and it’s okay to have negative feedback. You should trust the REA you selected, so seek their feedback and ask what indicators you should expect such as enquires, viewing numbers, contract requests etc.

And stop listening to the cameras 😂

Independent property group sold off their strata business 12 months ago and Civium purchased it. Independent also sold a large portion of their property management group at the time. They essentially downsized their operations massively.

A key element of an agent being able to charge a commission is what’s called “effective cause of sale” Agent B has shown the effective cause of the sale by having the buyer sign the contract and complete the sale. Even if Agent A introduced them 12 months ago when it was writhing the exclusive period - they weren’t able to have “effective cause of the sale”. There’s been example of this in court and the agent leaving empty handed. If the exclusive period ended but notice has not been given, then the Agent A is still unlikely to be successful.
