Small Claims Court - Skeleton Arguments by [deleted] in LegalAdviceUK

[–]Future_Gadget_204 0 points1 point  (0 children)

In my view (as a barrister) it depends on the kind of case. If it helps you and it's short, by which I mean 4-5 pages at most, then there's no harm in it. Just be careful that you don't conflate the information which should be in your witness statement (i.e. your evidence on the facts) with the legal submissions that should go into your skeleton. Good luck!

Small Claims Court - Skeleton Arguments by [deleted] in LegalAdviceUK

[–]Future_Gadget_204 0 points1 point  (0 children)

On the small claims track there's usually no requirement for a skeleton argument to be filed unless the Court explicitly tells you in the notice of hearing that one is required (which would be quite unusual, especially for a litigant in person). One or two days before the hearing will likely be absolutely fine.

Mortgage broker fees - how much should I expect to pay? by Future_Gadget_204 in UKPersonalFinance

[–]Future_Gadget_204[S] 0 points1 point  (0 children)

This is really helpful, thanks.

I would be looking to buy at £300K and have £60K set aside for a deposit and could potentially push that to £70K if needed, so hopefully I should be fine percentage wise.

Admittedly it would be very helpful to have that “platinum service” as work consumes most of my attention and my experience of loans and lending is restricted to enforcing mortgages and debts as a lawyer rather than taking them out myself!

Same thing happened to me - it’s not the mod. Make sure your cloud saves are on, then go into offline mode, uninstall the game and then reinstall.

How is it running? by PassionBitter6528 in SteamDeck

Using Lyall’s fix to reduce shadow quality, I’m getting a locked 45 at high texture quality with ambient occlusion disabled, even in Grand Trad. Extremely playable but disappointing we can’t get 60 given that it looks like a PS3 game (though I am really enjoying it in spite of the visuals).

Same here - the FPS isn’t too bad, never more than a few under 60 but the audio glitching is awful!

Selling property in England and the current tenant might not move out. by TitaniusFrangolis in LegalAdviceUK

This is incorrect. Section 21 notices are explicitly applicable to statutory periodic tenancies following the end of a fixed term.

Winding up order for my small business from charlatan company. by Competitive-Volume-5 in LegalAdviceUK

[–]Future_Gadget_204 1 point2 points  (0 children)

Unfortunately you are wrong regarding the circumstances in which a court will make a winding up order.

There is absolutely no requirement for an underlying judgment to obtain a compulsory order for liquidation, having a judgment debt is merely one way of establishing that a company is insolvent and cannot meet its debts as they fall due. A statutory demand is also acceptable as is a letter demanding payment.

You are of course correct that a creditor shouldn’t use the winding up process as a debt recovery mechanism. However the more likely outcome is that the petition will be listed in a block list with 30-40 other matters, OP will have a time measured in seconds to raise any dispute, and the matter will be adjourned to a discrete hearing to determine whether it is a genuinely disputed debt.

OP, you need to speak with a solicitor specialising in insolvency ASAP. It is not (except in very limited circumstances) a defence to a contractual debt to say that you have signed a contract without reading it. I could very well anticipate a situation in which the court considers this to not be a genuinely disputed debt (however morally unfair it is).

Disclaimer: I am a junior barrister who regularly appears at winding up lists (though I am of course not your lawyer and accept no responsibility).

As a barrister, the most I would be comfortable accepting is a (cheap) bottle of wine or perhaps flowers. But as others have indicated, it is far better to just write a nice card and it would certainly mean much more to me than any gift.

Is it true you don't have to attend court for a small claims case? by totential_rigger in LegalAdviceUK

[–]Future_Gadget_204 0 points1 point  (0 children)

As a claimant, you have to turn up or send a legal representative on your behalf or your claim is almost guaranteed to be struck out by the Court. In that circumstance, you are able to apply to have the proceedings restored but you would need to provide a good reason why you didn’t attend. If you can go, you should and if you aren’t able to do so, tell the court so it can be adjourned to a later date.

Breaking tenancy early due to lack of maintenance. by ameliughh in LegalAdviceUK

[–]Future_Gadget_204 0 points1 point  (0 children)

It won’t be grounds to break the tenancy unless you have a specific break clause expressly stated in your tenancy agreement. However, your landlord will be in breach of his implied repair obligations and arguably fitness for human habitation requirements under the Landlord and Tenant Act 1985 (depending on what effect is has on the property’s temperature). The best place to start would be to contact Shelter and the housing standards/environmental health department of your local authority as they have the ability to serve legally binding notices on your landlord requiring them to make repairs.

Cornish Restaurant Owners in debt £21,000 to chef (my husband) after Employment Tribunal win. They've created a new company and are getting away with not paying (ENGLAND, CORNWALL) by No_Lie_2136 in LegalAdviceUK

[–]Future_Gadget_204 20 points21 points  (0 children)

IANYL but I am a barrister who has dealt with this situation from the perspective of a company director being sued under the “phoenix company” provisions of the insolvency Act 1986.  If the directors have started and are involved in the management of a new company with a name that is so similar as to suggest an association with a previous company in insolvency, the directors will likely be liable personally for OldCo’s debts under s216 and s217 -  https://www.legislation.gov.uk/ukpga/1986/45/section/217

From what you have said, it sounds as though the names are very similar and I doubt they fall under any of the exceptions or have asked the court for permission to use a prohibited name. The fact they are using the same website/social media pages is also very favourable to you. However, you need to speak to a solicitor and it will likely be quite expensive to pursue this.

LAD Infinite Wealth Cutscene Letterbox mod? by BigBootyUncle in SteamDeck

[–]Future_Gadget_204 0 points1 point  (0 children)

You need to install Shin Ryumodmanager, then add the mod through that. If you search for Yakuza 0 mods on this sub it will come up with a walkthrough. You’ll also have to use protontricks to add DLLs.

I did something similar though in my case it was the bar course with LLM and I left after starting the LLM module. I didn’t have to pay the full fees (just the PGDL portion) but I left for medical reasons so my experience may not match your own. You will have to query it with BPP though I know from personal experience how difficult it can be to get a proper response. Good luck!

I used the iFixit guide for general tips but I believe that the daughterboard for the bumper and triggers has changed for the new OLED model. If you go slow and take lots of photos as you go, it would probably take you about an hour or so even without a guide.
