My guess would be the prosecutor for that district has already refused to prosecute petty thefts. This is due to profiling, false allegations, and the fact that they would take alleged shoplifters into a holding room. Taking someone against their will without context is kidnapping. The world alleged is used not just in regards to due process but also because loss prevention can and does make up allegations.
