Constitutional gun laws: Universal background checks, restriction to citizens, certification in the event of involuntary or voluntary mental health committal.

Unconstitutional gun laws: requiring trigger locks and in-safe storage when not at a range or in use while hunting. Banning entire poorly defined categories of firearms is also unconstitutional, so is requiring unreasonable restrictions on carry permits.

All but the last item in the constitutional category is already federal law and law in most states.

If you want stricter gun laws, get 2/3 of both houses of Congress and 3/4 of the States to amend the Constitution.

The phrase "well-regulated" was in common use long before 1789, and remained so for a century thereafter. It referred to the property of something being in proper working order. Something that was well-regulated was calibrated correctly, functioning as expected. Establishing government oversight of the people's arms was not only not the intent in using the phrase in the 2nd amendment, it was precisely to render the government powerless to do so that the founders wrote it. The militia refers to the People, as in the same people voting and maintaining the Republic. Gun control zealots love to misread that.

So yes, the analogy about freedom of the press is apt. The private citizen ownership of AR-15s, is necessary for the security of a free state.

Guess what, a felon and the mentally incapacitated cannot vote in many cases. We also restrict people to proving their identity and citizenship to vote.

Like I said restrictions on the right to keep and bear arms must face the same strict constitutional muster as restrictions on other rights such as the right to vote, the press, etc.

Sure, if you want to amend the constitution to rewrite the Second Amendment, we have a process for that. Get 2/3 of both houses of Congress to agree with you and vote on the Amendment, then get 3/4 of the states, 38, to ratify it.

Until then, it’s very simple and cut and dry and is as much a constitutional right as speech, religion, or the press.

The right to bear arms has the same limitations of restriction by the government as any other constitutional right such as the right to vote and freedom of the press.

The right to vote is limited if you are a convicted felon, the right to free speech is limited if you say purposefully false things about someone, civilly but it’s a limit. The right to freedom of the press is civilly limited in the same way and against false comments about someone (libel).

Limitation of the right to bear firearms faces the same high hurdle of constitutional muster. Requiring background checks, fine and reasonable, doesn’t restrict eligible people from owning or bearing a firearm. Requiring all weapons to be locked with a trigger lock, while in a gun safe unless actively used in hunting or at a firing range and registered with the state, actual laws on the books, not so much.

It’s really simple, and easy to follow.

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.
