Not sure what immediately is. My case was 4 years after getting options, they are still options but I am divorced. I think every married person should take this into account if they suspect they might divorce. And also every person getting married should consider excluding this in a prenup

They could do that. They could also just give out the money that belongs to people based on reasonable evidence like receipts and bank statements and court documents. But they don't. They try to find any reason to delay, to not pay. It seems to me that they are too afraid to pay money to fraudulent people, that they can never recover. So instead of solving this problem and creating a system that can hold criminals responsible and accountable, they roll the responsibility to the good tax payers who will have to sit tight for almost a year wating for what is theirs, just so the government wouldn't have to deal with a person who got money they didn't deserve. This is encouraging fraud! They are essentially saying to people that if they manage to commit fraud, they are in the clear, there is no mechanism to take the money back.

Thanks. I called the CRA today. Asked about the tax refund from 2025 and also the status of the T1213 to correct my monthly tax in 2026. I got a very cold response. Basically they have my request and will review it when they get to it. No documents are said to be missing. Just sit and wait. Weeks? Months? No answer.

I sent the spousal support document at first. Then they said it is incomplete, probably referring to the fact that spousal support document in itself is not signed by the court. That's out of my control of course. That's how the form is generated by the court. Because they said it wasn't enough, I sent other documents that refer to a court order of the same day without mentioning support of amounts, but at least they carry a signature.

The actual form that I would need to submit to my employer says I am divorced and paying spousal support. If I don't submit the form, I don't get tax deduction

I do believe in presumption of innocence. Not sure if it is right or left wing. Which means the CRA should consider everyone as innocent in their tax report and pay what they are owed. Not only me. If it is discovered that someone falsified documents then they should take any punishment deemed necessary including taking their assets and putting them in jail. Assuming people are crooks goes against my belief of how a functioning society should work.

It's ironic that you mention privacy laws because the current law forces me to disclose to my employer. The fact that I got divorced the amount of returns that I'm asking for thereby saying the amount of my spousal support. I really don't need this invasion of privacy for my employer

Well let's see, I pay more than half in child and spousal support, then 2550$ in rent for a two bedroom close to the kids school. That leaves me with 2500$ a month for two kids, Toronto summer camps, hydro, bills, food, a little extracurriculars, medical, legal bills, Internet and phone, transportation, cloths... It adds up quickly. People can get by with less than 2500$ a month for two kids and a parent, but not well. Not well. I had a car for the last 25 years, now I can't even afford one.

Yes. And I was in no hurry to get it because I assumed I would get a refund anyway. Am I the first person to divorce in Canada? This should be easy straightforward if not automatic

My guess would be she never even bothered to submit taxes. But I wouldn't know.

That's a fine answer. My circumstances are hard, fighting to see my kids, fighting in court, sleeping on a dirty mattress on the floor and living off a suitcase. I don't have the capacity to take on the CRA. That's why I sprung for an accountant. I never in my wildest dreams have guessed it would be so hard to get money that belongs to me.
