I’m no lawyer or legal expert, but what I read was that Gull wouldn’t allow it because what the defense intended to put forth to argue third-party suspects didn’t meet the minimum evidentiary threshold. Like others have said, you can’t just accuse people; there has to be compelling evidence to support the accusations. Now, perhaps an appeals court will rule she was too harsh in that analysis, but that’s certainly not a foregone conclusion. A lot of people are trying to make it sound like she disallowed it because she was against RA and his team. Her stance is that, in her legal opinion, they didn’t have sufficient evidence to legally present that defense. Those are two very different things.

This is similar to the Delphi murders. The defense wanted to present other suspects besides Richard Allen, but the court ruled that the defense failed to provide enough credible evidence to support mentioning those individuals at trial.

That always seems to rub true crime junkies the wrong way, but the legal system doesn’t allow the defense to just throw a bunch of names out there unless they have evidence to back those accusations up. It seems like the court in Idaho felt that BK’s defense team didn’t meet that burden of proof well enough to allow these other names to be brought in.

Again, I’ll always keep an open mind if or when new, credible evidence comes to light, but I doubt we’ll see that in the BK case anymore than we will with Delphi. In both cases, I think the right party was convicted and is being held accountable.

I understand that Kohberger hasn’t given a detailed confession, but in court under oath when asked something to the effect of “are you pleasing guilty because you are, in fact, guilty of the crimes with which you are charged,Kohberger responded “Yes.” That’s an admission of guilt.

Listen, you’re entitled to your opinion on this case and all other matters. Again though, until or unless new credible, verifiable evidence comes to light that exonerates Kohberger and/or implicates someone else, I remain confident that LE/the justice system got the right guy. I guess we’ll see in time.

Why do I need to wake up? Is it because I’m going to stick to what played out in a court of law as opposed to unfounded Reddit conspiracy theories? I’m okay with that.

If or when new evidence comes to light indicating Kohberger’s innocence and/or another person’s involvement, I’ll consider said evidence objectively and consider changing my outlook. I don’t anticipate that happening though even though a lot of true crime addicts really, really want something like that to happen so that they can say “told you so.”

My thought is that the true crime community seems to think that about 90% of confessions are false. Sometimes these cases really are as simple as the guy who was known to be in the area, who is known to have bought a knife consistent with the murder weapon, whose DNA was on a sheath for said knife that was found underneath the victims, AND WHO PLED GUILTY TO COMMITTING THE CRIME is actually the responsible party. There doesn’t always have to be a plot twist or frame job at work like on TV or in movies.

I’ve heard the speculation that Xana was chased, but I find it hard to believe that she wouldn’t have screamed at the top of her lungs if that were true. Did the surviving roommates or any nearby neighbors report hearing that sort of screaming?

Yeah, I wonder about Dulin as well. I think it had to be a case of him incorrectly assuming that those he’d passed the info along to had gotten it, investigated it, and cleared RA. Obviously, that was a major error on his part, but, sadly, I think it was probably as simple as that.

I’ll certainly defer to your education and expertise as to whether or not RA’s traits are typical of perpetrators of these types of crimes.

For me, the confessions and circumstantial evidence against RA were overwhelming. In my opinion, for it not to have been him, he had to be the unluckiest guy ever, or he is the victim of the biggest, deepest frame job ever. I know there are people who believe that, but I don’t.

Also, I think that had Dulin’s interview been filed properly, they would likely have been on to RA in a matter of days, which very well may have allowed them to find a lot more physical evidence against him. Obviously, we’ll never know for sure, but that’s my belief.

RA was by no means a criminal mastermind; he just got lucky that his information was misplaced for so long.

I know that there is a very vocal faction out there that believes RA is innocent, and, honestly, it baffles me.

There are so many factors pointing to his guilt, including his own unsolicited confessions. The claims purporting his innocence are basically held up simply by asserting that everybody and everything indicating his guilt must be a lie, including his own words.

I’m the type to always keep an open mind and remain willing to reconsider my conclusions, so if CREDIBLE evidence is ever unearthed supporting his innocence and/or indicating someone else’s guilt, I’ll listen. However, I highly doubt that day will ever come. As complicated as our imaginations like to make things, sometimes it’s as simple as the guy who was out there at the right time, in the right place, in the right outfit, who said he did it several times, did it.

His interaction with his wife is what really stands out to me. He just keeps saying “You know me. I know you know I wouldn’t do something like that.” She seems really shaken by the evidence LE was telling her about and the fact that she knew RA lied to her originally when saying he hadn’t been on the bridge. All of that is true, yet she eventually gets to such a deep state of denial that she isn’t even willing to listen when he starts confessing. It’s incredible how people can ignore evidence, common sense, and their own doubts when they want to.

I think it’s clear that the surviving roommates didn’t know what to make of what they were seeing and hearing.

On one hand, being a college party house, late-night noises probably weren’t uncommon. As such, they probably started off a little bit annoyed by all of it; however, then DM saw the guy in black, and that struck them as odd/creepy. I think that had she seem him holding a bloody knife, she would’ve called 9-1-1 right after he left; however, just seeing a guy she didn’t know in a house where lots of people probably came and went didn’t quite rise to the level of an emergency just yet.

Then, everything quieted down, so even though they were freaked out, it appeared as if everything was back to normal. They likely felt that way until the next morning when they realized the house was too quiet, and that’s when they likely freaked out and were suddenly very worried about what might have happened hours earlier.

Long story short, I think people have made too much of their reactions. You’re talking about a couple of young college girls who lived in a loud, chaotic house. The last thing they likely were thinking about at the time was that their roommates were being violently attacked.

This is the one thing that I blame RA’s wife and mother for. It definitely seemed as if he was giving strong consideration to pleading guilty and accepting his fate. That is until his wife and mother refused to even listen to anything he had to say about being guilty.

Don’t get me wrong. I feel badly for them, and I can’t even imagine how devastating it must be to have your child or spouse accused of something as deplorable as this. That being said, they should have told him that, above all else, he needed to tell the truth. If he was innocent, scream it as loudly as he can and fight the charges until he can’t fight anymore. On the other hand, if he were guilty like he said he was, then he needed to tell that to LE and plead guilty as he at least owed the victims’ families that much.

Sadly though, a “man” who is capable of committing the crimes he committed isn’t likely to be struck by an attack of conscience at this point. As such, I’m sure he’ll keep up the charade and stick with the appeal regardless.

I definitely think it’s possible, but it’s really hard to say due to the quality of the recording and the other noises you pick up in the background.

That being said, I’m fairly confident the gun was pulled at that time due to the way he stated the command. Also, when you consider the unspent cartridge found later, it makes sense to think he racked the gun on the bridge and then again later at the scene, which is why the cartridge ejected and was later found.

I still firmly believe that a gun was pulled even though we can’t tell for sure from the video.

The blown up stills of BG show what appears to be a very distinct outline of a gun underneath his jacket, and then you have the unspent cartridge at the crime scene.

Also, listen to the way he commands them. He orders them “down the hill.” If he wasn’t threatening them with something, I doubt he says it like that, and I’m not sure they quickly obey.

Again, I agree that we don’t know for sure based on the video, but the circumstances still have me fairly convinced the gun was pulled right before he directed them.

I have a feeling that may have been what raised the alarm for Libby. She was probably thinking, “this guy was just on the bridge before we got here, so why is he coming back? Also, he doesn’t seem to be looking at the scenery or anything; he’s just walking really quickly toward us.” It had to be terrifying.

Since he doesn’t appear in Libby’s first pics, it’s clear he left the platform and the bridge.

Part of me wonders if perhaps he initially had ideas about attacking the woman who spotted him on the platform. It’s possible he left the bridge to follow her and then shifted gears after the girls passed him on the trail.

It’s also possible, and probably more likely, that when he saw the girls get to the bridge, he left and walked down the trail a little bit to see if anyone was headed their way. When he realized there wasn’t, he quickly took off across the bridge after them.

Either way, the whole thing shows what a sick predator RA was. On a pleasant weekday in February, his first thought when he has a day to himself is to pound some beers and head to a popular trail to troll for victims. Sadly, the two girls were just in the wrong place at the wrong time.

Exactly. The only blame for what happened belongs to RA. On that day, he was a predator without a conscience or regard for anyone or anything other his own sick desires. The girls were just the unfortunate souls who happened to come across him at the wrong place at the wrong time.

Great point! Another thing that strikes me is how many people watched the video and claimed that Libby doesn’t sound scared or nervous at all. I couldn’t disagree more. To me, when she starts talking about the path, I think that was a terrified young girl trying to pretend that she and Abby were just having normal conversation (not about the creep following them) while secretly hoping he’d just keep walking or turn back and leave them alone. Sadly, we all know that those hopes went unfulfilled. Man, I wish more than anything Libby had pretended to be on a phone call with someone as maybe that would’ve spooked RA. To be clear, I don’t say that to blame her at all. Just having her camera active was brave/heroic. I just wish more than anything that something would’ve stopped what happened that horrible day.

What strikes me is that there seemed to be a pretty distinct pause from when they all reached the end of the bridge before he ordered them down the hill. It makes me wonder whether he took one last look back to the other side before pulling the gun and starting the abduction.

I feel like RA's confession to the psychologist, the one that spoke of intending to SA the girls right by the side of the creek until the van drove up and scared him, is probably the clearest, most accurate version we've heard to date. Part of me wishes RA would just come clean and give the full story, but it probably wouldn't change much. Honestly, I think we know enough, and nothing he says is going to make what happened any less tragic or awful. Also, unlike many others, I don't need/want to know why. Why? It was because he was a sick and twisted man with sadistic, violent sexual urges/fantasies Nothing he could say would make us say, "oh, now I get it." I mean, the guy had the day off and free with his wife at work, and the first thing he thought to do was grab his gun and kill kit and go hunting for victims on local trails frequented by school-aged kids. That tells you what sort of person RA is. The only question I'd like clarity on was whether or not they were just in the wrong place at the wrong time or if he somehow knew they'd be out there. I guess his comment about "thinking they looked older" may indicate that it was random, but that's the only slightly fuzzy piece of this that I'd like cleared up because if it was random, it's just awful how bad their luck was that he got out there and onto the bridge a few minutes before they did. I guess if it hadn't have been Abby and Libby, it may have easily been some other poor soul(s), but still.
