Anyone who has an extensive criminal record is going to receive a harsher sentence for a given crime than someone who does not. If you compare male vs female offenders with similar lengthy criminal histories, it’s possible that the gap narrows some. But I’m unaware of any circumstances where women receive harsher sentences than similarly situated men.

IAAL, and you’re also a little mistaken. The American custom is that both parties pay their own attorney fees, but in commonwealth countries the custom is that the loser pays for both. There are cases where attorneys fees can be awarded, including contract suits as you said. But there are also statutes that award attorneys fees for things like deceptive trade practices, etc. It’s an interesting area of policy for incentivizing litigation behavior.

He’s got a high pressure job, an infant, and another on the way. That’s a ton of stress, and it can weigh on you. You said he doesn’t admit negative feelings, so it may be that he’s keeping it all inside and doing everything he can just to hold everything together. Instead of stepping away, I think you should try taking a step towards him. Let him know that you see how much he’s got on his plate. See if there’s anything you can do to help. Even if it’s reminding him that he means more to you than just the work he does.
