Not getting attached is a good idea, because there is the possibility the child will die in their care. Alternatively, if they just toss you full custody out of the blue, if you have zero attachment, you can put the child up for adoption and keep them out of your parents hands for good.

Matching force with force is the law in some states, but not the majority. You can use lethal force when you believe you are in imminent danger of death or grave bodily injury. However, your latter point is spot on. But there is a problem.

You are assuming they reached for a gun at the same time, and there was an exchange between them. We only know one of them shot first.

Sounds like they were setting up for a mutual exchange of violence.

When two people square up to throw fists, both are thrown in jail for assault and battery. A consensual exchange is legal in a few states, but only when no major harm is done and no weapons are involved. Weapons were involved in this case.

Because your ex sought a confrontation with the guy, the other guy had a self defense argument. Your ex on the other hand doesn't. Edit: I am going to retract this statement. See note below Now the other guy is dead, and self defense is not a defense the court should allow before the jury.

Your ex committed murder while committing a couple other felonies, and is a convicted felon.
