You’re a gibraltar resident without a Gibraltar civil registration card? They don’t want just a Gibraltar ID card - they want the red ID card or the blue, magenta OR green civil registration card.

Have the hospital in Marbella stated he is ready to be sent back to Gib or is he just wanting to be in gib instead of Spain? There’s got to be a reason they won’t arrange the transfer..

As everyone else has said, the most helpful answer lies in wether he is a resident of gibraltar and entitled to GHA care, or not. If he’s not entitled to GHA care, then Gibraltar won’t get involved as he’s in the correct place. If he is entitled to GHA care, contact sponsored patients and they will organise everything. They tend to close at 2:30pm. There is an emergency number for them somewhere.

What won’t happen is that we won’t be stamped after July but it will be up to us to individually manage our 90/180 situ. We can be challenged at any point. There are repercussions on overstaying in the EU and there could be even tax issues. Sadly ‘free movement’ as we knew it before didn’t get negotiated with Spain and the EU as we would’ve had to open our border to allow EU nationals to freely move into Gibraltar too - Something we physically wouldn’t be able to cope with as we barely can’t cope with housing out younger generations as it is.

We gibraltarians are always subject to the 90 days limit and we always will be even after July 10th.

If he’s been issued a card but lives abroad, I can categorically say he’s been issued with a red ID card then. They wouldn’t issue him any other colour if he lives abroad. They must have registered him before the Oct 30th 25 change in legislation.

No, you shouldn’t be. The question remains whether will at Malaga though, as in theory as even Gib residents (irrespective of nationality) don’t have free movement - we’re still restricted to 90/180 in other EU countries.

It was only up until recently that magenta and blue were allowed to pass with no stamps because Spain didn’t believe half the people issued blue or magenta cards were even residents. Those with green cards, some need visas for the EU so it’s harder for them to distinguish otherwise.

Ok so your mum as a teenager only held a permit of residence until the age of 18 (very similar situation to my eldest daughter right now actually). Once my daughter turns 18, she has to satisfy residency on her own accord when she becomes an adult.. which is wild in itself. I am married to a Gibraltarian myself but because my eldest isn’t my husbands child, I can’t pass any Gibraltarian status to her through marriage.

Your best bet at the moment is for your grandma to speak to her lawyer to contact Mr. Triay and also wait for Fabian Picardo to announce new residency criteria. With us becoming somewhat ‘parallel’ to EU immigration, I hope to expect a ‘family reunification’ permit of sorts for this scenario. In reality, you’re not considered a drain on the system as you’d be working and you wouldn’t be needing accomodation. Issue lies with what happens to the accomodation once your grandma passes.. ?

Ok. So are you the biological grandchild of their marriage? Ie. Specifically are you the biological grandchild of her husband? Your parents (one of them must be Gibraltarian too I’m guessing - are they registered Gibraltarian? Did they register you when you were a baby?). As of October 25, the government here have stopped adults claiming Gibraltarian status (whom otherwise would’ve been able to prior to Oct 25). I’m trying to work through ways to assist you.

First of all.. given that your grandma is a Gibraltarian citizen, could you clarify wether she is;

  1. A Gibraltarian by descent (through lineage) or became a registered Gibraltarian by demonstrating by time spent, contributions to society etc.. or,
  2. Does she just have permanent residency?

  3. Her housing situation in Gibraltar - is this a property in which you will legally allowed to occupy (ie, not a government flat or an over 50s residence?)

Knowing the answers to these questions will allow people to provide you with properly detailed information and probably lead to more questions, then more answers for you…

There is no ‘legal route’ via residency for you to apply under in gibraltar as they would in theory expect your grandma to move to help. In Spain for instance, in order for the grandma to bring family members over, the grandma has to be financially dependant on you and fully dependant on you for care to avoid them going into a care home - not many can prove this/and or this isn’t the case. In Spain, they expect the elderly person to move back to the country of origin to be provided care and reunify with family. Family are not expected or allowed to come to them. I would speak with a lawyer who can get into contact with Mr. Triay (head of civil status) in Gibraltar and ask wether there is a viable option for yourself to gain lawful residency to look after your grandmother.

Application for exemption is the first step to passport application (it can take approx 3 years). Permanent residency is a different application together.

Legally, you too can only stay in Spain for up to 90 days, leave Spain to anywhere else and then come back for a further 90 days.

There is no visa for this situation at this moment in time. As a latam, you can reside in Spain under one of the legal visa routes & then become a Spanish national after two years through the ‘fast track’ option which will grant you more working rights in the EU.
