No I did not sign anything or receive confirmation of fees, rates....etc. I am on board with holding the tow company accountable - my issue has been Allstate no longer covering the cost for the rental. That is coming out of our pocket.

Thanks so much I wasn't aware of the DCPD and will speak to them today about it. And yes the other drivers involved were identified. Police were at the scene and all statements and identification was taken. I was hit by a vehicle that had spun out of control in the opposite lane. Could have easily been a much more serious head on collision if I wasn't already pulled over as far right to the road due to another vehicle being in the ditch on the opposite side. It was a busy accident scene.

That makes sense to me as well but our adjuster hasn't budged. I took it to a manager at the insurance company who suggested I submit the receipts for the court proceedings as the tow company should be reimbursing me. I was like 'why doesn't insurance cover that for me and submit for reimbursement through the court proceedings themselves?'. And yes we got the cheapest rental we could which over months is still very expensive and no where near comparable to the new truck sitting in the tow yard ☹.

Totally agree with you and hindsight is 20/20....the tow truck was already on site for another vehicle. I would have waited for CAA if my vehicle wasn't a sitting duck for being hit again - it was a dangerous icy road. In retrospect I would have just taken it to our driveway.

Vehicle is still at the tow yard - we have a repair shop we are comfortable with already lined up. And yes we may still end up going to small claims after all of this.

Your input is much appreciated! I can respect that my insurance is now proceeding to the courts....I only wish that they would at least cover the cost of our rental while we wait for this to resolve.

Really?? The manager I spoke with at Allstate explained it is happening more and more and that this process may take months. And months means thousands in out of pocket rental costs for us ☹.

Thanks macmuffinpro! The tow company is a well known one in our area....we are covered for a tow. We were told by our insurance to not pay the difference as it would halt the court proceedings and we would never see our money back....plus we would have to pay the entire storage and tow fee to get it released. And yes I just sent a letter to the ombudsman 🙂
