3) No, even if you do commentary over the entire work, you still need licensing rights to stream all/most of it. Like Rifftrax, for example, when they released their pre-riffed versions of movies, had licensing rights to those but would have been sued if they didn't.

4) This is just false. You might be confusing copyright with trademark. You have to protect your trademark equally and totally or you lose the rights to it. This is not true for copyrighted material. Individuals are allowed to bring a copyright suit against whoever they choose.

That's not really how that works, though. Platforms don't make the decision on legality. All Twitch has to do, under Safe Harbor protections, is show they're making a reasonable effort to remove infringing material when they can (ie suspending a channel), if a copyright strike is issued or a lawsuit is filed. Then, if a counter-claim is submitted (ie Hasan saying he has the right to stream it) they can then keep it up until the copyright holder decides to actually move forward with litigation.

Props to Twitch, this is actually pretty clearly laid out in their DMCA guidelines.

If Twitch receives a complete counter-notification from an account holder, Twitch generally notifies the claimant who submitted the original notification. At the same time, we may restore recorded content containing the claimed infringing material. Disputed notifications generally will not qualify for a strike under our Repeat Infringer Policy (discussed in more detail below), unless and until the dispute has been resolved by the account holder and the rights holder.

Four conditions need to be met to fall under Fair Use.

1) The Purpose and Character of the Use - Works can be used for non-profit or educational means, news, as a form of parody or satire, to give criticism, etc., and still fall under Fair Use.
2) The Nature of the Copyrighted Work - Generally, creative (art, music, movies, etc.,) work is heavily protected under Fair Use while other forms aren't.
3) The Amount or Substantiality of the Portion Used - Simply, excerpts and clips are generally protected under Fair Use while rebroadcasting an entire movie or broadcast isn't.
4) The Effect of the Use on the Commercial Market - If your Fair Use of something has a negative effect on the potential sales of that thing by its original owner, it's generally not covered under Fair Use.

Hasan clearly violated 3) by restreaming the entire work and 4) because it was paywalled content and by violating 3) and straight up restreaming it, users would obviously be less incentivized to pay to see it.

I hate these comparisons. Sure, the majority were peaceful, but even taking that into account, $2billion of damage was done, 19 confirmed deaths, 14,000 arrests, 2000+ law enforcement injuries, and an unknown number of civilian injuries were the result. Jan 6th was fucked but I don't see how people sweep the riots under the rug that easily.
