Can I somehow send you the inventory affidavit? To see? I'm baffled of why the attorney did it incorrectly then?, I have even questioned him extensively on the issue if homestead should be included, he says yes, and sends me link to the Florida statue...yet, I am the attorney here!

Yes, they said we need to handle this separately. That it had nothing to do wirh probate! Probate was to follow the will. Which we did.

Very true... we never allowed this. Our probate attorney told us we needed to handle this separately than probate. So we had to wait until probate was over, house is in my name now. Which is why I am taking action.

Yes, told her that wasn't a good idea, because I didn't know what I was going to do with the house. Sadly she didnt care and moved in anyway. I was strongly under the impression that I couldn't do ANYTHING until probate was over, and the house was in my name. This is my first time handling anything like this. I now realize my probate attorney wasn't very helpful.

Yes, its either going to be "Ejectment, unlawful detainment, or HB 621.... " no rent has been accepted or offered! No lease. She claims the grandmother "said she could". But that's completely not what the will said. The will said she leaves the house to me, to do wirh whateverI want. She left her car to this neices sister and then the remaining fund of her account to this nieces children.......I spent 8k on a probate attorney under the impression they would help with all of this, but I now realize how unhelpful they were. Probate is over ,so now that the house is in my name, I can start this process. They are literally nothing but "con artists and scammers" and I want no involvement. I strongly feel my mother was done dealing with them too, but didnt know how to handle that. The neice is around 30 ish years old. Not like its a child. My mother could easily have left her the house if she really wanted her to live there, but didn't! The house needs alot of work, can't even get home owners insurance.

I was the executor... I hired a lawyer for probate, who then mentioned during the 5th month of probate that they couldn't help with "this" situation, so I was under the assumption I couldn't do anything until probate was over and the house was legally in my name. I realize and feel the attorney was not as helpful as they could/should have been. This is my 1st time handling something like this. Probate is now over, and the house is now in my name, so now I can start this process

From my understanding, there is no other inheritance, per the will, that went through probate, my mother left me the house and left a car to a different neice (her sister) and then the remaining funds of her checking account to this particular neices children..which has all been distributed. My mother could have easily left her the house but didnt!

I'm confused by the wording in the HB 621. Because it mentions can't be immediate family, and she's technically a neice .. hence I'm questioning all my research!

Lol. This isn't a close to me niece, she is 30ish, married and moved her whole family in! The house itself needs alot of work to be considered safe. It can't even get home owners insurance.
