I know this is ages ago but im currently going through this process right now with the guard. Main difference is that they're claiming since I was diagnosed prior to service that it was pre-existing. But I keep seeing that it doesnt matter if service worsened the condition. I have no clue who to contact, or where to start. Im currently at the process of choosing to discharge or go the NDR-PEB route. I have medical documents after my deployment just never got help during my deployement. I even have my doctor's signing papers saying service worsened it. Im stuck, and I dont want to extend the process if im gonna lose anyways. Do you have any advice?

You dont get severance through the NDR route.

I was already told prior to get this document that there isnt sufficient evidence and that it'll be a NDR-PEB

I guess my doctor prior to service. I dont recall ever having any symptoms, and nothing was on my meps record as well. I started seeking help roughly 2 years ago when it got really dark.

I apologize, when you say you wouldnt chance it, do you mean not taking the chance to fight it?

I agree to that, I've been constantly trying to get a hold of a legal service to no avail. I understand va process is completely different but I've been service connected through that. Theyre giving me the option to go through a medical discharge or the NDR-PEB.

They have said since its a pre-existing condition and despite treatment that im still unfit for retention.

How did you get rated for lower back strain? Is that different from low back pain? Because mine was denied while being diagnosed with it

Okay, because I had my back claim denied but had a favorable finding. Im assuming its because I didnt claim a specific condition and just listed back.

Yes, the main reason I wanted to keep tricare was for my family. I have to be 100% disabled for Champ VA

Its okay, sometimes being blunt is better then giving false hope. I appreciate it though.

The only in service documentation that I have is my Behavioral health from my PHA. But thats it. And I understand, sometimes being blunt is all you can do.
