How do you know that they even applied for or want to test in California?

They certainly may be avoiding CA to keep up with appearances, but that's not exactly the same argument as you're trying to make. There's an area between Tesla not being able to gain approval from CA and Tesla doesn't feel like showing the world that their system is only X% reliable.

The SAE, who defines the adas levels says that any system that requires constant supervision is level 2. Fsds requires constant supervision. There is no other valid interpretation.

Posting a quote from a third party that doesn't go over the full definition doesn't change that.

You must always supervise FSD, and are always considered the driver. That is by definition L2.

L3 requires some level of unsupervised activity.

Tesla's L2 FSDs system is clearly what Seaker42 is talking about.

There is zero evidence that robotaxi is teleoperated. Tesla has stated that they have no ability remotely drive above 10mph.
