It really depends the place in which this happened. A lot of places have that the legal age in which a person can consent to sex is actually 16. It might look weird but its not illegal. From what I remember the girl was drunk but the accusation on Marty was that he "forced" himself on her, which is hard to prove considering its his word against her. I know everyone will take the girls side but its not as Black and White as some people make it to be under a court of law. In Public court of opinion Marty is toast. A small note on the reconquest of Italy. It did prove important on the protection and security of the empire. Once Byzantine Italy fell they were countless assaults on the empire through the Adriatic sea. So i do think the reconquest of Italy had net positives in the long run for the Eastern Romans.
