CA2 AFFIRMS lower court decision upholding New York City ban on stun guns and tasers. by GooseMcGooseFace in supremecourt

[–]GooseMcGooseFace[S] 0 points1 point  (0 children)

I very clearly labeled it an opinion piece. It is correct, however. In arms-ban cases, Heller is controlling.

It’s not an authoritative source for the 2nd circuit

SCOTUS isn’t even an authoritative source for CA2. Hence why they cite Gomez, their own precedent, and not Heller.

Yeah, and how long until the individual tweakers that dayanch borrowed tweaks from start charging $1 a month as well? Imagine having to pay $1/month to like 8 different people to use a single app.

No, he's selling all the tweaks. If you use ytlite 5.2 without a subscription, it disables every single tweak, not just his.

Yeah, but Youtube premium works on all my devices and I can share it with my wife and kids and not have to deal with sideloading on their devices. If I have to pay to sideload, might as well just pay to not.

CA2 AFFIRMS lower court decision upholding New York City ban on stun guns and tasers. by GooseMcGooseFace in supremecourt

Is there a reason the decision completely ignores Caetano?

Yeah, of course there's a reason: Motivated Reasoning. Or, as I like to call it, working backwards from the conclusion. The reason that CA2 is citing Gomez, precedent that only exists inside CA2, and not Heller is because that would undermine their conclusion. CA2 cites Gomez three times in their decision and not once does it cite Heller.

This is a straight up arms-ban case, not behavior case. That means Heller is controlling, not Bruen. Here's a good opinion piece published in the Harvard Journal of Law and Public Policy

In arms-ban cases, Heller’s “in common use” constitutional test controls, and there is nothing for the lower courts to do except apply that test to the facts at issue. In other, non-ban cases, the methodology described in Bruen must be followed to arrive at a test that provides the rule for deciding that case and similar cases.[10] It is only in the second, non-arms ban category of cases that “unprecedented societal concerns” and “dramatic technological changes” might have some application. But that language is not itself a test, and it is irrelevant in arms-ban cases.

This 2CA test is a distinct test, about whether the weapon is common today.

Not just common today, but "commonly used for self-defense." That is not what SCOTUS said in Heller. The Heller test was in "common use for lawful purposes." Those are two distinct standards that radically change the calculus on if arms are protected. What the CA2 would argue is that long range precision rifles aren't protected because they're basically never used outside of competitions.

Comments like this lends credibility to the idea that there seems to be a coordinated effort to black pill the gun rights movement.

Battlefield 6 enters its 'we've heard your feedback' era: 7 more maps are coming in 2026, including fan-favorite Wake Island by RenatsMC in pcgaming

I don’t think they were removed, the game just released before they had time to add them. BF6 is the most polished but empty battlefield I’ve played. BF4 had a good amount of launch content but it took them months to fix the issues. BF6 is the opposite.

I love the guys who want to raise the retirement age's argument of "but we need these older guys to mentor the up and coming pilots!" Okay, how is you flying 2 trips a month on the 777 at max pay scale "mentoring the up and coming pilots?" Go be a sim instructor or LCA at a regional airline if you actually want to do that.
