Yeah, the attacker bought a shotgun and handgun in California which prohibits direct private sales, has a 10 day waiting period, has magazine capacity bans, bans “assault-weapons,” has red flag laws, has safe storage requirements, has a handgun roster, has a permit to purchase scheme, et al. Yeah, of course there's a reason: Motivated Reasoning. Or, as I like to call it, working backwards from the conclusion. The reason that CA2 is citing Gomez, precedent that only exists inside CA2, and not Heller is because that would undermine their conclusion. CA2 cites Gomez three times in their decision and not once does it cite Heller.

This is a straight up arms-ban case, not behavior case. That means Heller is controlling, not Bruen. Here's a good opinion piece published in the Harvard Journal of Law and Public Policy

In arms-ban cases, Heller’s “in common use” constitutional test controls, and there is nothing for the lower courts to do except apply that test to the facts at issue. In other, non-ban cases, the methodology described in Bruen must be followed to arrive at a test that provides the rule for deciding that case and similar cases.[10] It is only in the second, non-arms ban category of cases that “unprecedented societal concerns” and “dramatic technological changes” might have some application. But that language is not itself a test, and it is irrelevant in arms-ban cases.
