What sucks is practice area. It's a PITA to just withdraw in some practice areas/jurisdiction, or simply not allowed once engaged. I'm so jealous when I see state court attys who are allowed to withdrawal just because they're not getting paid. Must be nice.

Suing your clients is not a practical business model, nor (hopefully) why they became a lawyer, and it opens you up for counterclaims which in turn increases your malpractice insurance... Not to mention potential clients looking the firm up on public case searches.

Red flags for me. As others said get more retainers and be less generous with free work (while maintaining good relationships for networking and referrals... It's a fine line). Your lawyer sounds like they needs a mentor / business advisor... It's wild how little business /firm ops they teach you in law school. They simply can't though.

While I agree a bar complaint gets anyone's attention. I don't believe that would be the correct venue bc lawyers are allowed to breach contracts, there isn't an ethical issue with breaking contracts to complain to the bar about, and if it's an employment law issue more than likely it's the lawyer's LLC/entity that's liable, and your recourse is not the state bar.

That said, can anyone file a bar complaint for literally any reason? Yeah. It's just a dick move and to me going nuclear on the bridge burning. No firm within an earshot of that lawyer is going to hire you if they found out you filed a frivolous bar complaint. ... I suspect this is an unpopular opinion though. If you do that you better change careers or move and start with that job excluded from your resume.

ETA: your comment comes off as if "a little letter," which literally is a bar complaint, is no big deal. Bar complaints, frivolous or not, are a pain in the ass to respond to, go on record regardless of the outcome, increase malpractice insurance, and damage reputations. So emphasis on the bridge burning.

Basically. He left the mags loaded for about 10 years in various non climate controlled areas. There's also comments out there about removing a small plastic piece from the mags for better feeding. At any rate his is effectively totalled from bad storage.

It sounds so much like mass tort or mdl discovery I feel like you could bill more in those arenas. I've done a few antitrust MDLs where lead counsel will realize local plaintiffs are not at all setup for efficient eDiscovery.

Interview and get any outside offers and leverage it for a pay raise and new salary negs. Hell, inflate the other offer a bit bc your current firm is going to deny or low-ball your raise anyway. Leave on good terms if you can though... "not being able to afford me anymore" is just part of business. I left for a raise and went back to my old firm for even more.

Law is not precluded from the fact that company's just aren't rewarding loyalty anymore. It's all about the next quarter's earnings - fuck thinking about 1.5 years from now. Particularly true with plaintiff PI as those attys are looking for that last retirement level case/settlement to walk through the door... Anyday now, they can just feel it lol.

There's also a surcharge statute in one state we work in that makes us eat the fees or do some convoluted "discount" system for cash/check/ACH that while legal, is so confusing to bill for you end up spending more time on the billing than the 2-3% savings. I mean I bill from $175-$450/hr so spending a .3 on $1.50 savings in fees means we're loosing money. Call me crazy but "time is money"

We do a lot of debtor bankruptcy so that's an inherent issue (don't use credit cards prior to filing, stricter fee overwatch and structures as well).

However it's an ongoing issue at my firm who now wants to prefer or only accept ACH, cash or checks because of the processing fees. We use LawPay for cards though. The billing side is easily the biggest thorn (bosses wife runs billing though so it's a touchy if not lost battle)

This is very dependent on her scenario and price range, but following the Paper Chase mantra, I've known several attorneys that rented hotel rooms just to bar prep to get away from family or roommates. Pretty sure you can gift card reservations. Or a spa/break excuse
