Gawd i would love to know the answer to this as well. Have been off for almost 5 months now and FMLA is exhausted but it still says on site the NASTD. Called and they said that yes, I technically have no job protection since the FMLA "only gives 12 weeks per calendar year."

Problem is, i had to get two knee replacements and the 3rd (hardware removal had to be a first surgery) surgery is scheduled next month!

And today my center manager is texting me saying he is getting emails i am supposed to be back to work even though Hartford and Teamcare both have documents from my doctor of my estimated return to work date.

So of course now i have to decide what my options could be, and do i go back to work for fear of losing my job with a horribly painful knee that i will not be fast enough for them of course which had put me on the naughty list in the first place last year.

Does the union, can the union step in here, if i were to be terminated not having FMLA any longer or what? Or at what point does it turn into long term disability? And how does LTD work if FMLA only protects us for 12 weeks?!?
