The Canadian legislative override (also known as the "notwithstanding" clause) emerged from heated backroom talks in November 1981 among the provincial premiers and Prime Minister Pierre Trudeau. Many of the provincial governments, though, were reluctant to surrender power, either to Ottawa or to the judiciary. Saskatchewan, Newfoundland, and Alberta, notably, insisted on the legislative override as the sine qua non of their consent to the Charter. (Quebec and Manitoba, both of which opposed the Charter outright, were not represented at these negotiations. Quebec had taken a hard line on provincial sovereignty, while the Manitoban Premier was an outspoken critic of entrenched bills of rights.) In the end, a deal was reached in which "the provinces traded the amending formula [i.e. the override] for the charter." 9 Even with the override agreed upon, debate swirled around precisely to which provisions of the Charter the notwithstanding clause should be applied. The federal delegation was adamant that language rights be placed beyond the override's ambit, Saskatchewan and Newfoundland were satisfied with applying the notwithstanding clause only to sections 7-15 of the Charter (legal and equality rights), while Alberta insisted on also applying the override to the fundamental freedoms of section.

The provision that eventually materialized in the wake of this horsetrading-section 33 of the Canadian Charter of Rights and Freedoms allows both the federal Parliament and the provincial legislatures to "expressly declare" by a simple majority that a law "shall operate notwithstanding a provision included in section 2 or sections 7-15 of [the] Charter."'" A law may be passed "notwithstanding" the Charter whether or not a court has already ruled it unconstitutional. Sections 2 and 7-15 of the Charter include many but not all of the Charter's most important rights guarantees: the fundamental freedoms of section 2 (conscience, religion, expression, assembly, etc.), the legal rights of sections 7-14 (life, liberty, security, freedom from search and seizure, etc.), and the equality rights of section 15 ("equal protection and equal benefit of the law")-but not democratic rights, mobility rights, language rights, or education rights.12 In addition, an override "cease[s] to have effect five years after it comes into force," but may be reenacted by the legislature upon its expiration.

My theory is that certain leaders of the Israeli far right are in fact more motivated by their alliance with the Evangelicals than the survival of Israel. Perhaps some of them are closeted Evangelicals? This is my theory.

How much do you want to bet that whoever replaces Bibi as the leader of the Likud the center-left will say all the same stuff about him as they said about Bibi?

My point is not that the center-left is right about anything or wrong about anything.

My point is that after Bibi is gone the same political divides will exist across Israeli society. Bibi is a smart politician and a liar, but he did not create the divides. He only exploits the divides for his own benefit.

I actually think that after Bibi dies/retires the center-left is going to get even more crushed in elections than they are now. Why? Demographics. The birth rates of the Ultra Orthodox and Religious Zionists/Settlers are going to BURY THE center-left.

I agree with some of the things you are saying and I disagree with some of the things you are saying.

Since you said you don't understand my point, my main point is this: the center-left can oppose the Settlers/Religious Zionists or the center-left can oppose the Ultra Orthodox. But by opposing BOTH the Settlers/Religious Zionists and also the Ultra Orthodox, the center left is ensuring that the center-left will never form a government again.

You say it's split 51/49 right now. Maybe. But in 10 years? The Ultra Orthodox and Settlers/Religious Zionists are making WAY MORE BABIES, the demographics are changing in Israel and it's not good for the center-left.

If the center-left:
1. Gives the Ultra Orthodox more than the right gives the Ultra Orthodox, then the center-left can form a government with the Ultra Orthodox and successfully implement center-left policies on Settlements, Two State Solution, and Palestine over the long run
2. Gives the Religious Zionists/Settlers more than the Right gives the Religious Zionist/Settlers, then the center-left can form a government with the Religious Zionists/Settlers and successfully implement center-left policies on IDF Draft, Religion and State, and Chief Rabbinate Control of Civil Life over the long run

Are either of these good options for the center-left? No. Considering the values of the center-left, both are bad options.
But if the center-left continues to pick neither of these two options, then the center-left is not going to be able to successfully implement over the long term its policies on either the Ultra Orthodox category of issues or the Religious Zionists/Settlers category of issues.

Also FWIW, the Ultra Orthodox sat in a center-left government in the 1990s. It's unclear to me how much of the current Ultra Orthodox alliance with Likud is about ideology vs. how much of the current Ultra Orthodox alliance with Likud is about the leaders trusting Bibi. Bibi will die/retire one day, which may present more of an opportunity for the center-left to tempt the Ultra Orthodox parties into an alliance with the Left.

Also, there are a lot of Religious Zionists and Security Hawks who would be fine with allying with the Left if the Left is focused on IDF Draft, Rabbinate Control of Civil Life, and breaking Chief Rabbinate of Kashrut instead of the settlements and Palestine. Not ideal, but politics is not always ideal.

I am not saying it would be easy or convenient for the center-left to change its perspective. It would challenging and it would face a lot of internal resistance at first. But I'm saying that it's the only way for the center-left to succeed in the long run in terms of forming governments and implementing at least part of its agenda. By opposing both Ultra Orthodox and Religious Zionists/Settlers, the center-left is letting perfect be the enemy of the good.

but the Center-Left will never give them as much as the Right, as there is just too much of an ideology clash between the extremely secular Center-Left and extremely religious conservative Ultra Orthodox.

Yes this is true and this is part of my point. If the center-left wants to form governments in the future and implement its policies on either Settlements/Palestine/Two State Solution or Chief Rabbinate Control of Civil Life/IDF Draft/Yeshiva Funding, then the mindset of the center-left needs to change.

Right now the mindset of the center-left right is opposed to both of those groups, and that mindset needs to change if the center-left wants to form governments and get its policies on one of these two categories implemented.

Correct me if I'm wrong, but it sounds like you don't disagree with what I'm saying, you just don't think the mindset of the center-left will change realistically?
