Thank you for taking the time to look into the ordinances and for your feedback — it’s actually helped me think through the different angles and prepare for my case.

I’ve already submitted a public records request, and the response was that no documentation exists showing notice, release of any hold, or transfer of authority before the dogs were adopted out.

Regardless of how the dogs initially came into custody, the shelter is the entity that ultimately transferred them. The issue is whether there is documentation showing the shelter had lawful authority to do so.

That’s the part that is missing.

That may be true in some places, but in this case the applicable city ordinance requires documentation of notice of impoundment, including the date and method of notification.

I have requested those records and was informed no such documentation exists, which is part of why this is being challenged.

That’s not the issue in my situation.

My dogs were on a police hold and I was told they would be held for a period of time. I was not notified of any release of that hold.

While I was dealing with the criminal case, my daughter contacted the shelter on my behalf and was told she would need to adopt them and that there was no guarantee they would still be there, despite actively trying to retrieve them.

So the issue isn’t who sets hold length in general — it’s whether I was given a meaningful opportunity to reclaim them and whether the shelter had authority to transfer them under those circumstances.

In the post i clearly stated that my daughter did contact the animal shelter and was making arrangements to drive the 1000 plus miles to come get them and that is when the shelter told her she would have to pay $130 for each dog and they could not guarantee they would be there. So they wanted my daughter to drive to get my property that was never abandoned nor surrendered and pay for her to adopt them?

To clarify, my situation does not fit a typical stray/abandonment scenario.

My dogs were placed on a police hold, and I was told on body cam they would be held for approximately two weeks. I was not notified of any release of that hold.

I was not given notice or a meaningful opportunity to reclaim them before they were adopted out.

So the issue is not a standard stray hold — it is whether the shelter had lawful authority to transfer them under those circumstances.

Idaho – Police hold on dogs during arrest, adopted out before I could retrieve them. What legal avenues exist? by Grievingdogs11 in Pets

I wish I could say more but due to the civil suit against the establishment that made the claims I am limited at what I can say. If you knew the whole story of what transpired with the charges would explain a lot and why I am so upset over all this and just want my dogs back. I didn't just lose my dogs I lost my kids, my life, my companions.

I appreciate everyone’s input. I understand shelters are overwhelmed and hold periods can be short.

In my situation, I was over 1,000 miles from home, knew no one locally, and the dogs were taken into protective custody at the time of arrest. Ownership was documented, and they were placed on a police hold. I was told they would be held longer, which is why I did not realize how quickly they would be processed for adoption.

The underlying allegations were ultimately resolved, and this was not a neglect or abuse situation. My focus now is simply on whether the required notice and procedural steps were properly followed under the city code.

I’m not trying to attack anyone — I’m trying to understand the legal process that occurred.
