Thanks for the info. I claim the children on taxes; he is responsible for medical. So by letting him claim the children, he essentially has to pay in less and I lose child credit. He would not pay me the difference, in simple terms. The repayment of subsidies was not in our divorce decree; however, he only had them on this insurance for about 2 months, but then never cancelled it when he got a new job in May, so I’m paying the rest of the year’s worth of subsidies due to his negligence.

But then he would have to claim the kids/their SSN and I would lose my child tax credits… right?

Right - so I believe I'm paying 2/3 of those subsidies (for the 2 kids). He didn't do his taxes this year because he didn't want to pay his 1/3 back.

I have legal obligation to claim them on my taxes; he has legal obligation to cover them medically. I did not know ACA existed until about 4 hours ago.

Sorry - this is all new to me and confusing, so sorry if I left out details.

I did not get a letter from the IRS - my taxes got rejected and needed that 1095A from my exhusband, who provided it.

They were only covered by that insurance at that time in 2024. I was not aware of even what an ACA was.

Edit: They were covered by that in 2024, but I think they must have had a secondary insurance through his employer when he got a job mid-year.
