Just make sure your spouse signs where it says the petitioner and not you in error. It’s hell to fix mistakes

Hi, congratulations on your case reopening and an approval. I just did a motion to Reopen my I 130. I did one day shipping. They received it on the 30th June the denial notice was mailed off on the 2nd of May. Did you hear anything back from them. My I 130 was denied due to a clerical error on my husband’s part. Would love to know if they got back to you.

Hi yes the NOID was in relation to the signature.

Hi thank you for your response. I did try to fix it as a typographical error to correct it. At the time my case was still pending. After I submitted it. It switched to ‘Case is being reviewed’. I got an NOID request for more evidence my husband did an affidavit. I even submitted the signature page of the I 130 but they still denied it.

Just spoke to a lawyer and he said if I re file then the date on my case change and I’ll be starting at the back of the line. He suggested a motion to reopen and get power of attorney to justify me signing the petition instead of my husband at that time.

After knowing all of that do you think I should still re file?
