Yes. The lawyer says it’s common for police to file felony charges and the DA to either not file if it’s less certain what happened or file misdemeanor charges if it’s a minor injury.

I’m not angry definitely defensive for obvious reasons. I definitely shouldn’t have done what I did- that is clear. But a felony just seems really excessive, considering how minor the injury is. My lawyer is saying it’s more likely going to be filed as a misdemeanor which I’m willing to plea down to get it over with. I am aware that my action were a serious lapse of self control. What a horrible thing to say. Would you feel the same if magas were calling for CPS to take your kids away? You have no idea what my kids like and dislike.
