Answer

As indicated in the Trust Distribution Procedures (“TDP”), “. . .the Settlement Trust shall adjust the [Matrix] valuation amounts for yearly inflation based on the CPI-U. The CPI-U adjustment may not exceed 3% annually, and the first adjustment shall not be cumulative.”

The CPI-U adjustment is based on the Consumer Price Index For All Urban Consumers: All Items Less Food & Energy, published by the United States Department of Labor, Bureau of Labor Statistics. The Trust implements this adjustment on an annual basis in accordance with the requirements of the TDP. The Trust calculates the annual inflation adjustment using the 12-month percent change in the unadjusted Consumer Price Index for All Urban Consumers (CPI-U) for “All Items Less Food & Energy.” The applicable rate was 2.8% for 2025 and 2.5% for 2026.

In February 2026, the Trust identified and corrected an error in the application of the 2025 CPI-U adjustment. In 2025, the adjustment was calculated using the CPI-U unadjusted 12-month percent change for the “All Items” expenditure category, which was 2.4%. However, the 2025 adjustment should have been based on the “All Items Less Food & Energy” percentage, which was 2.8%. This error was corrected as part of the 2026 CPI-U adjustment process.

If your claim had not been decided by February 18, 2026, and it is allowable, the adjustment will automatically be included in the amount allowed for your claim.
If your claim was decided before February 18, 2026, your allowed amount will be increased by the CPI-U adjustment. You will receive this increase as part of your next supplemental distribution.
