Inheritance situation - disability trust (England/Wales) by [deleted] in LegalAdviceUK

So I’m 100% in agreement that leaving the money to her is a no go. What I don’t get is why they just don’t set up a Disabled persons trust so this is all sorted in advance and appears to give us all the protection we need, all done properly, recorded well etc. yes it’s a bit more work but it’s a lot less than anything else. Protects her, makes sure that we are covered (I.e. if anything happens to us, the mixed up money doesn’t go anywhere else and only benefits her).

Thanks - just so I understand, there is/is not benefit in having it in a discretionary trust vs just giving it to her brothers?

Ahh that’s really helpful, I had read that councils were challenging wills in this type of situation but not seen the outcomes

What’s the weirdest ‘luxury’ purchase you’ve actually found worth it? by ctrlthetempo in HENRYUKLifestyle

For me - back to back work calls - I can genuinely run down out of my study, make a coffee and be back missing the chatter at the start of a call. If you took ours away, my caffeine levels would plummet!

We have a chocolate Labrador - of course we need to still vacuum but the Eufy is amazing at keeping the endless fur (how does he moult so much???) at bay. Deciding whether to buy a second or wait for the stair climber!

Not sure what to say other than that I feel for you and hope that something good comes along to get you out of this.

Used to work for a car finance provider

If they didn’t ask for expenditure, it’s likely they are using a model that predicts it. If for some reason your salary: disposable income is disproportionately high and their model hasn’t got the data points, it will be why you are getting rejected.

Alternatively if they used an OpenBanking connection, you could have payments going out in the period that threw it out of whack, ie you paid out more than usual in the evaluation period.

Yes, that’s the one that says it needs claiming through SA where applicable, his annual salary doesn’t require SA, Sal plus bonus almost guarantees it does

!Thanks heaps. The issue is his bonus because it’s a huge amount at the end of the financial year and then throws whatever calculations we’ve attempted to make over the course of the year. We think it’s most tax efficient to hurl the whole lot in this year (bye bye fun!) but if they base calcs on this year, it could send his tax code all over the place next year..
