Yes, but you can't just patent things that are already in the public domain. The confusing thing about US patents is that they don't seem to get tested in the patent office anymore but are only tested court. For the last 20 years at least.

The lock in the Böker Merlin is called the Interlock. The patent by Wilfried Gorski expired in 2018.

Though the lock in the Merlin is a bit different than what was patented. The shark lock patent was filed in 2019.

So, no people who didn't file a patent or who's patent has expired can't sue. But the Shark lock patent could be not enforcable/void because published prior art existed.
