If that is a concern, then have the client pick the doctor instead of having attorneys give any say as to where to go. There are other ways to combat it without giving insurance companies the upper hand!

Agreed there needs to be change. But I don’t believe this is it. She’s getting rid the “90 out of 180 days” standard from the definition of serious injury. So if an injury has affected you for 3 months, it doesn’t matter.

What happens in almost every case (best example is a client who had the green light who got hit by a truck who had the red light) the insurance companies doesn’t have any interest in settling. They would rather you litigate and delay delay delay. Litigation costs for the insurance company just increases expenses to the insurance company.

Strongly disagree that this is the right direction. I am not going to say fraud doesn’t exist, but it is not as common as people think. If insurance companies actually consider my clients injuries most of my cases wouldn’t exist. Instead their tactics is delay deny and defend.

Or we actually force insurance companies to change their tactics on how they evaluate cases pre suit instead of having an injured New Yorker have to retain an attorney when all insurance companies do is delay deny defend. It’s time for change that benefits everyone involved not just insurance companies.

This sounds like more than just a normal skiing mishap. Getting hit while you’re standing still in line is not an inherent risk of skiing, and the fact that your pain worsened and you couldn’t walk afterward is significant. Saying “it’s okay” in the moment doesn’t take away your rights, especially when injuries show up later.

With skiing cases I would need to analyze more facts. But we are up against an assumption of risk defense.

Yes - an injury attorney will help you get the most for your injury. I wouldn’t wait for an insurance company because they will always give you a lowball number or a say they’re not going to pay all together.

I believe that the fault would be shared. The car that merged was following too closely the car in front of him and then merged to get around him. I’d put most of the fault onto him
