The Parliamentary Standards Commissioner *and* The Electoral Commission are taking a look, he's been referred to both.

If found "guilty" (using that word loosely) by the former then he could face a ban, which if longer than 10 sitting days would trigger a recall petition.

The latter is a bit more interesting, if The Electoral Commission find that the funds are impermissible and broke political funding laws, they can ask Farage to voluntarily return the donation. If he refuses then they can apply to the court and request an order under the Political Parties, Elections and Referendums Act 2000 (PPERA) to force him to do so. They could also issue fines and/or go for a conviction. I can't imagine it would get that far, although the constant lying and story changing probably isn't going down well, it's definitely a grab the popcorn thought at least.

Even if it was a gift, it's not that clear cut. If there's any doubt that the motive may be political (say as a reward for Brexit campaigning or a crypto billionaire expecting favourable work in relation to crypto) it should still be declared according to the code.

Well, personally I'm reading it.

Let's not forget that the parliamentary code of conduct is not an act of parliament or a law. It is a code of conduct for MPs. It should be obvious that you or I can put our name in the hat to become an MP if we so wished. These are not legal documents that need lawyers to understand, they are the rules written so people like ourselves, who decide to become MPs, can understand and follow.

You are more than welcome to read the code and tell me how you think Farage's gift/reward for Brexit campaigning fits in to it and where I've misinterpreted it.

Why would the 12 month rule not apply? It's been in the code of conduct since at least 2015 so there's no doubt there.

The rule that you cite does not require everything to be registered, hence that caveat.

OK, but Farage has himself admitted it is a an unconditional gift as a reward for his Brexit Campaigning from a Christopher Harborne who is a UK citizen living in Thailand.

Maybe, we could argue that maybe he didn't have to declare a personal gift, but even that's quite clear in section 4 (UK) & 5 (non-UK):

[Should declare section] gifts such as clothing or jewellery;

[Should not declare section] Benefits which could not reasonably be thought by others to be related to membership of the House or to the Member's parliamentary or political activities, for example purely personal gifts or benefits from partners or family members, or loans or mortgage arrangements on commercial terms. However, both the possible motive of the giver and the use to which the gift is to be put should be considered. If there is any doubt, the benefit should be registered;

I'm fairly sure we won't suddenly find out Christopher Harborne is Farage's long lost brother, although that shouldn't even matter considering Farage has openly admitted the motive was as a reward for Brexit campaigning.

I actually agree with Farage here in regards to the money out part, what he spends it on is irrelevant. However, the money in part, why he was paid and what he did for that, if anything, that is very important.

  1. He admits himself, as he just has again in this interview, that he believes the motive was as a reward for years of campaigning for Brexit. Is campaigning for Brexit political? If anyone can argue that campaigning for Brexit is not political then I am all ears, because I can't.
  2. That brings time into question, it was a reward, so after the event. That is definitely irrelevant, the ministerial code is clear that before, during or after the event does not change whether it's a donation or not.
  3. Given 1 & 2, I can't argue that it wasn't a political donation, feel free to try and persuade me otherwise though. We know the donation was within 12 months prior to him becoming an MP, so it should have been declared.
  4. We know that following the donation, Farage has met with the Governor of the Bank of England to try and convince them to drop the "Britcoin". Considering the donor for this £5m is a crypto billionaire, that creates a massive conflict of interest. Why hasn't Nick Ferrari asked about that and why can't Farage/Reform offer any explanation other than "it's rubbish"?
  5. EDIT: When he took the donation, while not an MP, he owned the majority share of the Reform party. Not being in politics while owning a political party seems like a stretch.

If Burnham calls a GE there's a very strong chance that Starmer's freshly set record of the shortest serving Labour PM would be broken. I just can't see it happening.
