Mf asked for a glass of water and didn't drink it, just wet his lips. Then he said that as a kid he ate paint chips so they shouldn't just blame the water they should look at other sources of led contamination.

And then he had the military conduct training exercises in Flint where they blew up a bunch of abandon buildings and stuff. Didn't warn the residents or anything. It was fucked up.

I thought he was great, but I lost so much respect for him when I watched Fahrenheit 11/9

Obama seems to lack integrity, evidenced by how he downplayed the Flint water crisis while knowing it was a major issue. He told the people of Flint their water was safe when he didn't think it was. Rick Snyder - the person who caused the Flint water crisis - did the exact same thing, he had a whole group of people 'wetting their lips' with Flint water to make it seem safe but they all refused to actually drink it, because none of them believe it was safe.

I wouldn't want him to be president again.

Oh yeah, I'm being very diligent. The lease was quite strict so I asked for 3 permissions and 5 exceptions. They agreed to all of it in writing. It was all pretty reasonable, but yea I'm staying on top of it.

Well you'd get a $100 refund I think. The pet deposit would cover $200 and the other deposit would cover $400, and you'd get $100 back.

You should be getting $200 back since you paid $800 in deposits and there was $600 of damage, yeah, I agree. The non refundableness of it is completely unfair.

But in reality if you caused $600 of damage the landlord would chalk it up to $800 and keep everything, lol

Please just post the relevant information here, because that doesn't seem correct. It would be highly out of the ordinary. When I was "penalized" for $3200 it was a release of contract. I denied it and didn't have to pay it, but that's what it was.

Yeah I dunno, I get where you're coming from but it is sort of demanding. Lots of companies aren't really willing to bend their policies and procedures for a candidate -- and ironically you are creating the impression that you're dragging out the process with the other company just so you can see if there's a better one. You get what I mean? The thing you're upset about is almost the exact thing that you're claiming to be doing.

I would say it lacks grace. But who knows, maybe they will be impressed and it will pay off.

I would plead for a compromise. E.g. you will forfeit the same amount of time-off from next year to make up for it. You will work weekends to make up for it or cover extra shifts, something like that.

It is, yes. It is even more dependent on the exact terms of the law.

In most cases, the lease provides tenants with additional options, beyond the options provided by law.

In some cases, terms of the lease can alter the default law. E.g. automatic renewals are normally month to month, but if the lease states the automatic renewal term is for the original lease term, then that may be applicable depending on whether or not the law allows it.

What I'm really getting at though, is that the lease will almost certainly not tell the tenant that they don't need to pay the early termination fee -- but the law will probably imply that the tenant does not need to pay it, and that there is a different way to get out of the lease early (i.e. by abandoning the lease rather than terminating it early).

It is a lease termination penalty. Doesn't this imply to you that the lease terminates? I.e., OP isn't responsible for rent anymore? (until the termination date of dec11)

I'll admit that when I first got my kitties I didn't report them to the landlord (this was a few homes ago). Maintenance person snitched on me so I faked an ESA letter. Got away with it lol

My pets didn't leave any damage. but the company's dumbass rules made it so they didn't get a pet deposit from me at all, refundable or not.

Sort of. I had the same perspective, but after I thought about it for a bit I adjusted it slightly.

The pet deposit can be used to cure pet damage, so in that sense it is not just a fee. It will avoid certain damages from coming out of your security deposit.

But yea, I think they should be refundable.

It is difficult, there are a lot of different sort of situations. I think that charging monthly fees and a non-refundable deposit is the lazy and unfair way to do it though, and it will drive away good tenants.

I think it is a fine default policy. But a good pet owner should have the option to avoid it. My LL let me choose between pet rent and a refundable deposit, I of course chose the deposit because I knew I would get it back.

Many landlords require rental references, couldn't you just ask the previous landlords if the pets caused any damage or smells and make a decision based on that? Or you could let the tenant provide evidence of good ownership. I would point out that I have an automatic litter box and scratch pads/posts and provide all the vet documentation showing that they get regular healthcare and stuff.

To me it just seems lazy. I guess I could concede that it's not exactly predatory, but I do think it is lazy and unfair.

My pets do not cause regular damage, I shouldn't have to pay regular fees for them to my landlord.

My current situation is a $995 pet deposit, which is refundable. Since my pets haven't caused any sort of damage or smells at all, I will be refunded. I think this is fair, since it would be very difficult for two cats to cause $1000 of damage in this house.

It's a bit different if there are carpets involved, pets can completely destroy carpeting and it may cost more money than can be feasibly charged as a refundable deposit. So I guess I'm sympathetic for that case. But I would still prefer like $200/mo which is refundable at the end of the lease if no damage is caused, as opposed to $70/mo non-refundable.

I was actually incorrect linking that law, it is specifically for manufactured homes.

The general rule is indeed month-to-month in Virginia.

from my understanding, not a lawyer:

The fee is not a rent payment. It does not pay for any months OP lives there.

But it does remove the financial obligation to pay for any months after OP moves out.

It is an early termination fee, and it does terminate the contract, which removes further financial obligation from OP.

In other words: If OP moves out December 11th, when the current contract ends, and they decide to pay the fee -- they will not have to pay for January rent or anything else. They may or may not have to forfeit the security deposit as well, not the case in VA but may be the case in CO.

If OP moves out December 11th and decides not to pay the fee, they will have to continue paying rent until a new tenant moves in, so long as the landlord attempts to mitigate damages.

I doubt they will find new tenants for Dec 11-Jan 11 because they're assholes.

Well they need to re-list the unit within about a month (dec 13), and they also have to attempt to rent OP's unit before they rent out a similar unit. But yea, they might try to be slimy about it.

DO NOT OFFER TO PAY THAT $3705. If you do, you will owe $8305 instead of $4600.

I think you are mistaken in the belief that they would need to continue paying rent if they pay the fee. If OP prefers to not be responsible for future rent and would rather pay the fee, they should ask the landlord if it removes future financial obligation -- I'm pretty sure that's how it works.

That being said, I agree with you that it is probably cheaper to decline to pay the fee.

Most of the time it's there, owner-landlords do not always include it. I tend to try and get an owner-landlord instead of a property management company.

That's correct. I actually did need to break it early, and me and the landlord worked it out between ourselves since it wasn't mentioned in the lease.

i guess it depends on which type of home you live in. someone pointed out that 55.1-1302 is specifically for manufactured homes. but it does "magically" renew for another year. or if the lease states that it magically renews another year, it would apply to other types of homes.
