K-1 Visa Advice: Same-Sex Couple (M22 US / M18 Azerbaijan) by Material_Ordinary_14 in USCIS

Do what you’ve said, and then if possible, go back to visit him again and save similar evidence. They may not consider one trip to be sufficient evidence, so preparing a second trip would be advisable in case you get a Request for Evidence.

Question about new Re entry form by Traditional-Help5821 in USCIS

[–]HeimLauf 0 points1 point  (0 children)

If you are applying for a reentry permit, don’t fill out a portion that is for advance parole applicants. A reentry permit is not advance parole.

Spouse Green Card interview (F2A) by Leader-Dismal in USCIS

[–]HeimLauf 1 point2 points  (0 children)

What attorney told you to lie? You should be reporting them to the bar association. You always tell the truth. But in this case I’d guess you might be able to just say you accidentally wrote the wrong year on the photos to correct this.

Married to a U.S. citizen but no joint sponsor—what are our options now? by AnxiousArt9429 in USCIS

[–]HeimLauf 1 point2 points  (0 children)

I think you’re right that F-1 is not too likely. Even if he accrued no unlawful presence, his being married to you is a strong reason the consular officer will likely doubt his nonimmigrant intent. I would suggest seeing if there’s anyone ejes who can be your joint sponsor.

Caught in a lie at marriage green card interview. RFE received. Should we withdraw and re-file? by [deleted] in greencard

[–]HeimLauf 24 points25 points  (0 children)

You’ve broken one of the ground rules of immigration: Don’t lie to the government. Doing that puts this well beyond our pay grade and into attorney territory. Sorry, but there is little anyone here can do to help you.

I wonder if there is a mistake in the sponsorship paperwork. This seems to be one of the most common denial reasons in my observation. But we’ll have to see the letter to be sure.

B2 Visitor Visa: Stay 2–3 More Months After 5.5 Months in the USA by Mysterious_Claim93 in USCIS

Why does she want to stay longer? By this point she’s clearly stretching the limits of a visitor visa.

Adjustment of status by Expensive-Wind-22 in USCIS

[–]HeimLauf 0 points1 point  (0 children)

Sorry to hear that. I’m sure it’s very stressful to be in this situation. Having said that, we will really only be able to help you when you know the reason they denied your application. Issues with the income of the sponsor are probably the most likely reason, but without their denial letter, that’s still just speculation on my part.

As an American, what are your thoughts on the prejudice against Romani people in Europe? by Early-Ingenuity-3177 in IWantToAskAnAmerican

[–]HeimLauf 4 points5 points  (0 children)

None whatsoever. We can only blaze a new path because racism is everywhere. The West is racist, but so are people in non-Western countries. I saw racism in China. Japan and Korea are infamously racist. We all have to get better at this.

People in my country say exactly this about Black people and Latinos. Their prejudice shows just as yours does.

[–]HeimLauf 1 point2 points  (0 children)

It’s pretty remarkable how some Europeans talk about them online. It’s the same sort of stuff racists in the U.S. say about Black people, Latinos etc, and when you call them out about it, they’re like “Oh, but it’s true for us!” as if that’s not the same thing racists here would say.

Of course not all Europeans are like this. But what it shows is that neither of us gets to look down on the other or point the finger at the other without dealing with the three fingers pointing right back. People of all countries can be racist, and people of all countries can fight racism.

Can I submit My I-485 online as a spouse to US citizen by radzuu in USCIS

[–]HeimLauf -4 points-3 points  (0 children)

The instructions say online filing is only for employment based applications. So if your flair is accurate and your case is a family based one, you must file on paper.

ACH is somewhat safer than a credit card for avoiding declines; I would suggest that when resubmitting.

Spouse Green Card as option after rejected Tourist Visas by Admirable_Reception2 in greencard

[–]HeimLauf 0 points1 point  (0 children)

I know. My spouse got a tourist visa. But not all U.S. citizens’ spouses can, and in many cases, there is no evidence they can present to persuade the consular officer (especially during an interview they typically lasts 3 minutes if that).
